المبــادئ الحديثــة للمرفــق العــام فــي ظــل الدستــور الجزائــري الجديــد لسنــة 2020

Abstract

يكتسي المرفق العام أهمية بالغة لما له ارتباط وثيق بالأف ا رد وحاجياتهم الأمر الدي يمكن ان يمس بحقوقهم وحرياتهم الدستورية ، فكان لازما عمى المؤسس الدستوري حمايتها بوضع ثلاثة مبادئ اساسية وهي: مبدأ الاستم ا ررية, مبدأ المساواة وأخي ا ر مبدأ التكيف المستمر ؛ ومع استم ا رر مظاهر الفساد الإداري بكل أشكاله متسببا في سوء تسيير وتدبير المرفق العام أدى بالمؤسس الدستوري إلى استحداث مبادئي جديدة لاخمقة وحوكمت الإدارة العمومية. ما هي أهم المبادئ المستحدثة لتسيير المرفق العام وفق دستور ج ا زئري لسنة 0202 ؟ وما هي الهيئات الدستورية التي تضمن تجسيدها ؟ وللإجابة عمى تساؤل الإشكالية قسمنا الد ا رسة إلى فصمين؛ خصص الأول منه أهم المبادئ المستحدثة لتسيير لممرفق العام. اما في الفصل . الثاني ركزنا عمى الهيئات الرقابية التي تضمن تجسيدها في ظل دستور 0202 لنستخمص في الأخير أن مبدأ الشفافية ,مبدأ الحق في الوصول لممعمومة ,مبدأ المساءلة والرد عمى الطمبات , مبادئ دستورية لا يجوز مخالفتها ، وبغية تجسيدها لاستعادة هيبة المرفق العمومي أعاد تفعيل آليات الشفافية الخارجية والداخمية عمى غ ا رر هيئة وسيط الجمهورية , المرصد الوطني لممرفق العام ، السمطة العميا لمشفافية والوقاية من الفساد ومكافحته المفتشية العامة لمصالح الدولة والجماعات المحمية.The public service has a great importance because it is closely related to individuals and their needs, which can affect their constitutional rights and freedoms. It was necessary for the constitutional founder to protect them by establishing three basic principles: the principle of continuity, the principle of equality and finally the principle of continuous adaptation, and with the continuation of manifestations of administrative corruption in all its forms, causing The mismanagement and management of the public service led the constitutional founder to introduce new principles of morality and the public administration was judged. So, what are the most important new principles of the public service in the 2020 constitution? And what are the constitutional bodies that guarantee their application?. In order to answer the problematic question, we divided the study into two chapters. The first one, it was devoted to present the most important new principles of the public service in the 2020 constitution. As for the second chapter, we focused on the most important constitutional bodies that guarantee their application. In the end ,we conclude that the principle of transparency, the principle of the right to access information, the principle of accountability and response to requests are constitutional principles that cannot be violated, and in order to application it and to restore value and the prestige of the public service, the constitutional founder reactivated and found external and internal control institutions such as the Republic’s Mediator, the National Observatory of the Public service, the supreme authority for transparency, prevention and control of corruption, the General Inspectorate of State interests and local groups
