الحماية الجزائية للبيئة البحرية في التشريع الجزائري

Abstract

يعتبر موضوع تلويث البيئة البحرية من المواضيع التي حظيت بإهتمام كبير من طرف الباحثين والعلماء، وذلك كونها تعتبر الوسط الطبيعي المناسب للكثير من الكائنات الحية، كما تحظى بأهمية إستراتيجية وسياسية وإقتصادية في حياة الدول. وفي ظل ما شهدته التنمية البشرية من تغيرات وتطورات في مختلف القطاعات أدت في أغلب الأحيان إلى الإضرار بهذه البيئة، وإحساس المجتمع بالخطر الذي يهددها، فقد أصبح من الضروري إعتماد العديد من الأطر القانونية لمواكبة هذه المتغيرات وحماية البيئة البحرية من الأضرار التي قد تصلها من جرائها. وهنا تتجلى أهمية الحماية القانونية وخاصة الجنائية للبيئة البحرية، حيث ركز المشرع الجزائري وبالتفصيل على أقل جزئياتها لمكافحة الجرائم التي تمس بها. The marine environment is one of the topics that has received great attention from researchers and scientists, as it is considered the natural milieu suitable for many living organisms (biota), and also enjoys strategic, political and economic importance, for both countries and people. In light of the changes and developments witnessed by human development in various sectors which often led to damage to this environment, and for the society's sense of danger, it has become necessary to adopt a number of legal frameworks to cope with these changes to protect the marine environment from the damage that may be caused by them. Here, the importance of legal protection and especially the criminal one of the marine environment is highlighted, thus, The Algerian legislator has focused and in detail on the least of its components to combat the crimes that affect it
