Abstract

"الملخص تُعد عملية الترقيم العقاري المؤقت أول إجراء يقوم به المحافظ العقاري لتأسيس السجل العقاري، الذي يكون ناتجاً عن عملية مسح الأراضي العام، وما لهذه العملية من أهمية في ضبط الحقوق العقارية والمحافظة عليها وإقرارها لأصحابها بصفة نهائية، باعتبارها الآلية الأولية لتأسيس السجل العقاري . حيث كلما كانت عملية المسح مضبوطة بصفة دقيقة، وكانت وسائل الإعلان والإشهار أكثر فعالية وذلك لتمكين المعنيين بالحضور للإدلاء بملاحظاتهم فيما يخص عملية وضع الحدود وغيرها، يعود هذا بنتائج ايجابية على عملية الترقيم العقاري المؤقت، وذلك بالتقليل والحد من المنازعات المترتبة عنها، التي تُعتبر إشكالية تُعرقل من إتمام عملية تأسيس السجل العقاري. يتنوع الاختصاص القضائي بالنظر والفصل في منازعات الترقيم المؤقت بين القضاء العادي والإداري وذلك بحسب طبيعة النزاع والإطراف، إلا أنه هناك بعض الثغرات التي من شأنها أن تُبقي هذه المنازعات محل إشكال قائم، الأمر الذي يستدعي مراجعة بعض النصوص والأحكام المتعلقة بالترقيم المؤقت بهدف ضبط الملكية العقارية .
