إشكالات العقارات الممسوحة و المسجلة في حساب المجهول و طرق تسويتها

Abstract

الملخص: لقد واجهت عملية إعداد مسح الأراضي العام في الجزائر عدة عراقيل منها قلة الإمكانات المادية ونقص الإطارات التقنية المؤهلة ، بالإضافة للظروف الأمنية التي مرت بها بلادنا خلال تسعينيات القرن الماضي ، وهو الأمر الذي نتج عنه تأخر إتمام العملية من جهة وعدم دقتها وفعاليتها من جهة أخرى ، ويتجلى ذلك من خلال تسجيل عدد كبير من العقارات في حساب المجهول ، وهذا يتنافى والغرض الأساسي من عملية مسح الأراضي. غير أنه ونتيجة لهذه الوضعية تدخلت المديرية العامة للأملاك الوطنية في العديد من المرات لبيان كيفية تسوية وضعية هذه العقارات و تطهيرها من حساب المجهول ، إلا أن هذه التعليمات و المذكرات تبقى غير كافية مما اضطر العديد من الحائزين و الملاك للجوء إلى القضاء لتسوية وضعية عقاراتهم ، وذلك ما وقفنا عليه في هذه الورقة البحثية حيث نبين طرق تسوية وضعية العقارات المسجلة في حساب المجهول سواء عن طريق الإجراءات الإدارية أو عن طريق المنازعة القضائية . Summary: The preparation of the public land survey in Algeria has faced several obstacles, including the lack of material abilities and the lack of qualified technical executives. In addition to the security conditions experienced by our country during the 1990s of last century, this resulted in the delay of completion of the operation on the one hand and its inaccuracy and effectiveness on the other. This is evidenced by the registration of a large number of real estate in an anonymous account, which is contrary to the primary purpose of the land survey. However, as a result of this situation, the Directorate General of National Properties intervened many times to show how to settle the status of these properties and clearing them from the account of the unknown, but these instructions and memos are not enough, forcing many holders and owners to resort to the courts to settle the status of their properties; In this paper, where we show the ways of settling the status of real estate recorded in the account of the unknown, whether through administrative procedures or through judicial dispute.
