Abstract

وتهدف السياسة الاقتصادية الجزائرية حاليا إلى تشجيع رؤوس الأموال الأجنبية في البلد من أجل إنعاش الاقتصاد الوطني، لذلك كرس المشرع مبدأ حرية الاستثمار والتجارة، مما أتاح للأجانب القيام بأنشطة تجارية على الأراضي الجزائرية بموجب نص المادة 20 من القانون 11/08. ويجب أن يكون مؤهلا قانونا لذلك، وفقا لما تحدده القوانين واللوائح التي تنظم شروط ممارسة هذا النشاط، ومن أجل ممارسة نشاط تجاري، من الضروري الحصول على بطاقة مهنية بموجب المرسوم التنفيذي رقم. 06/454 على البطاقة المهنية المسلمة للأجانب الذين يمارسون نشاطا تجاريا وصناعيا وحرفيا أو مهنة حرة في الإقليم الوطني. تُعرف هذه البطاقة باسم بطاقة التاجر الأجنبي لأنها تكتسب مركز التاجر، مما ينطوي على آثار والتزامات مهنية مثل مسك الدفاتر التجارية والتسجيل في السجل التجاري. وقد فُرضت عقوبات مدنية وجنائية على الإخلال بهذه المسؤوليات، وهي عقوبات ذكرتها الرقابة المفروضة عليها. Algeria's economic policy currently aims to encourage foreign capital in the country in order to revive the national economy, so the legislator enshrined the principle of freedom of investment and trade, allowing foreigners to conduct commercial activities on Algerian territory under the text of article 20 of Law 11/08. It must be legally eligible for that, as defined by the laws and regulations that regulate the conditions for practicing this activity, so in order to practice a commercial activity, it is necessary to obtain a professional card under Executive Decree N°. 06/454 on the professional card delivered to foreigners who practice a commercial, industrial, and craft activity or a liberal profession on the national territory. This card is known as the foreign merchant card because it acquires the status of a trader, which implies professional effects and obligations such as commercial bookkeeping and registration in the commercial register. Civil and criminal penalties have been imposed for breaking these responsibilities, which are mentioned by the control imposed on them.
