السندات الإدارية المثبتة للملكية العقارية الخاصة

Abstract

حاول المشرع الجزائري بعد الاستقلال تنظيم مسألة إثبات الملكية العقارية بإصدار ترسانة هائلة من القوانين منظمة للعقود والقرارات الإدارية، وتكمن أهمية السندات الإدارية المثبتة للملكية العقارية الخاصة في أنها صادرة من جهات إدارية رسمية في الدولة، ولها قوة إثبات أكبر عن غيرها من السندات الأخرى، كالسندات التوثيقية والسندات القضائية، وأيضا هنالك سندات إدارية مثبتة للملكية العقارية الخاصة تسلم إثر عملية التحقيق العقاري، والمتمثلة في شهادة الترقيم المؤقت والدفتر العقاري الذي يعتبر السند الوحيد المثبت للملكية العقارية بعد إنتهاء عملية المسح العقاري.After the independence, the Algerian legislator tried to organize the issue of proving of real estate ownership by issuing a huge number of codes regulating contracts and administrative decisions. The importance of the administrative documents of proving private real estate ownership lies in the fact that they are issued by official administrative bodies in the country. It has a stronger proof than any other kinds of documents as notarial and judicial documents. Also, there are administrative documents that prove private real estate ownership are delivered after the process of real estate investigation which are represented in temporary numbering certificate and real estate book (property register), which is the only document proving real estate ownership after the completion of the real estate survey process.
