ضمانات حماية الحريات السياسية بين النصوص الدستورية و الممارسة الميدانية

Abstract

ملخص: اختلف الكتاب و الباحثون في تحديد الضمانات الدستورية لحماية الحريات السياسية، إلا أنهم أجمعوا على أهمية تلك الضمانات لممارسة المواطنين الحريات بكل مساواة وعدل في مجتمع تسوده القيم الديمقراطية،أخد المشرع الجزائري بضوابط مسار دساتير الدول الديمقراطية ونص في مختلف دساتير الدولة الجزائرية بما فيها أخر تعديل دستوري سنة 2016 على مجموعة من الضمانات لحماية الحريات السياسية . لكن على أرض الواقع أثبتت هذه الضمانات عدم فعاليتها نتيجة حرمان المواطنين من حقهم في تسيير شؤون بلادهم و حقهم في المعارضة و النقد و الإصلاح، بمعنى أخر سلبت منهم أغلب حرياتهم السياسية، هذا ما أدى إلى حدوث انفجار تجسد في الحراك الشعبي .
