الأحكام القانونية لرخصة البناء في الأراضي الفلاحية

Abstract

تعرضت الكثير من الأراضي الفلاحية إلى سوء التسيير والاستغلال وتم تحويل وجهتها الفلاحية إلى أراضي عمرانية، حيث احتل الاسمنت والحديد مكان المنتجات الزراعية، نتيجة لذلك ضبط المشرع حقوق البناء على الأراضي الفلاحية بما يساهم في رفع طاقتها الإنتاجية مع وجوب الحصول على رخصة ادارية مسبقة تسلم وفقا لإجراءات وشروط محددة تراعي الطابع المادي للأرض الفلاحية. A lot of agricultural lands were exposed to mismanagement and exploitation, and have been diverted to urban areas, where cement and iron replaced the agricultural product. Therefore, the legislator adjusted (set) the Construction rights on agricultural lands, which would contribute to increase its production capacity with the necessity of obtaining a prior administrative license to be delivered in accordation with procedures and specific conditions that take into account the physical nature of the agricultural lands.
