ضوابط تطبيق القانون ـ حالة التعارض بين النصوص ـ

Abstract

إن التطبيق السليم للقانون يقتضي إلمام المطبق بالضوابط اللازمة لذلك خاصة في حالة التنازع و التعارض و الغموض، ذلك أن جهل تلك الضوابط أو تجاهلها يؤدي إلى تجاوز النص الواجب التطبيق و إهدار أهدافه بما يمس بسلامة الأحكام القضائية و يهدر حقوق المتقاضين، و من بين أهم الضوابط تلك المتعلقة بعلاقة النص العام مع الخاص، و علاقة النص المطلق مع المقيد. The proper application of the law requires the applied knowledge of the necessary controls for this, especially in the case of conflict, conflict and ambiguity, because ignorance of these controls or ignoring them leads to exceeding the text to be applied and wasting its objectives in a way that violates the integrity of judicial decisions and wastes the rights of litigants، Among the most important controls are those related to the relationship of the general text with the private, and the relationship of the absolute text with the restricted.
