الاتجاهات الحديثة للمسؤولية الجنائية للأشخاص المعنوية (فقها وقانونا)

Abstract

يتناول هذا البحث ماهية نظرية المسئولية الجنائية للشخص المعنوي التي تسود في بعض التشريعات الحديثة، ويرسم معالمها كما صورتها الآراء الفقهية والقضاء الجنائي الداخلي، والتي لا يعرف الكثير سوى القليل عن عناصرها وتطبيقاتها. ومن ثم سيكون بمثابة الأساس لنكشف بوضوح تام عن صورة هذه المسؤولية المطبقة في زمن السلم والحرب. كما يشكل نواة لفهم أكثر لفائدة تطبيق هذه المسؤولية، ويسلط الضوء على مسار الجرائم والعقوبات المقررة حاليا على مستوى النظام القانوني الوطني، ويصور هذه المسؤولية كعملية فعالة في ضبط سلوك الشخص المعنوي. إذ قد يتبين أنها أكثر نجاعة في سبيل تحقيق مصالح المجتمع.This paper discusses the theory of criminal responsibility for the moral person which is frequently used in recent legislations. In this study. many concepts are taken place to be dealt with as they are stated in juristic opinion and internal criminal justice. in order to talk about its components and applications. Therefore. it will be the basis to explain clearly the status of this applied responsibility in war and peace. In addition to that. the paper represents a rule aiming to explain the use of applying this responsibility. and focuses on the way crimes and punishments are being discussed and approved recently at the level of national legal system. This responsibility shows its efficacy in adjusting the moral persons' behavior; that it is described to be more productive and fruitful in order to fulfill the society's interests.
