التدابير الإجرائية لمكافحة جرائم التمييز وخطاب الكراهية على ضوء قانون 20-05

Abstract

أقر قانون 20-05 ال المؤرخ في 5 رمضان عام 1441 الموافق 28 أبريل سنة 2020، يتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما، الذي أقر منظومة إجرائية خاصة لمتابعة المتشبه في ارتكابهم لهذه الجرائم بوسائل حديثة، تتماشى مع تطور وسائل وتكنولوجيات الإعلام والاتصال، من قبيل تفتيش النظم المعلوماتية والتسرب الإلكتروني، وتحديد الموقع الجغرافي للمتهمين، كما أجاز ذات القانون اللجوء إلى إجراءات التعاون الدولي عند الاقتضاء.

كل هذه الإجراءات شرعها المشرع الجزائري في إطار مكافحة جريمة التمييز وخطاب الكراهية، وحماية الفئات المستهدفة والحفاظ على الوحدة الوطنية والقيم المجتمعيةLaw No. 20-05 of 5 Ramadan 1441 corresponding to April 28, 2020, related to the prevention and combating of discrimination and hate speech, was passed, which approved a special procedural system to follow up on those suspected of committing these crimes by modern means, in line with the development of media and communication technologies, from Before inspecting information systems and electronic leakage, and determining the geographical location of the accused, the same law also permitted resorting to international cooperation procedures when necessary.

All of these measures were legislated by the Algerian legislature in the context of combating the crime of discrimination and hate speech, protecting the target groups and preserving national unity and societal values.
