لجوء العمّال إلى التظاهر السلمي كوسيلة للتّعبير الجماعيّ

Abstract

لما يعجز الشّركاء الاجتماعيون عن تحقّيق استقرار علاقات العمل، وتعجز حتى آليات التّسوية الودّية بما فيها الاضراب عن تسوية النزاع، وفي غياب قنوات للحوار الجاد يلجأ العمّال إلى التظاهر السلمي كوسيلة تعبير جماعي والضغط في آن واحد. أصبحت ظاهرة اللجوء الى التظاهر السلمي في الجزائر ملفتة للانتباه، ورغم تكريسها في القانون، إلا أن الافراط في ذلك أصبح أمرا مقلقا يستوجب الدراسة، بالبحث عن الأسباب وتداعياته للحد منها، عبر تفعيل آليات أكثر فعالية لتسوية النزاعات بهدف تحقيق السلم الاجتماعي. When the social partners are unable to stabilize labor relations, and even amicable settlement mechanisms, including strikes, fail to settle the dispute, and in the absence of serious channels for dialogue, workers resort to peaceful demonstration as a means of expression and collective pressure at the same time. The phenomenon of recourse to peaceful demonstration in Algeria has become perceptible, and despite its consecration in the law, the excess has become a worrying subject which requires to be studied, by seeking the causes and its repercussions in order to reduce them, by activating actions more effective dispute resolution mechanisms with a view to achieving social peace
