مخطوط تحلية الذهب في علم القضاء والأدب لأبي عمران موسى المازوني(ت833ه) دراسة وتحقيق: (من اللوحة25 إلى اللوحة36)

Abstract

نضع بين أيديكم بحث علمي قمنا فيه بتحقيق جزء من نوازل القاضي أبو عمران موسى بن عيسى المغيلي المازوني "تحلية الذهب في علم القضاء والأدب"، تطرقنا فيه إلى طرح الإشكال التالي، وهو هل هذا المخطوط الذي بين أيدينا صحيح النسبة إلى مؤلفه؟ وهل هذه النسخة ترقى لإخراج الكتاب كما أراده مصنفه أو قريبا منه؟ وللإجابة عليه قمنا بتقسيم هذا البحث إلى قسمين، الأول؛ دراسة حول المؤلِّف المؤَلَّف في فصلين احتوى كل منها على مبحثين، والثاني قسم التحقيق؛ والذي قمنا فيه بكتابة المخطوط بالكتابة العصرية وترجمنا فيه للإعلام الذين ذكرهم المؤَلِّف كما عزونا نصوص المسائل إلى مصادرها، وأخيرا توصلنا من خلاله إلى بعض النتائج والتوصيات، من أهمها بروز علماء إجلاء من أمثال أبو عمران رغم معاصرته لمرحلة اتسمت بالضعف جراء الحروب والفتن، كما تجب العناية بدواوين النوازل الفقهية وتحقيقها سواء الدفين منها أو الذي حقق ويحتاج إلى تحقيق. This scientific research aims to investigate a part of the calamities of Judge Abu Imran Musa bin Issa Al-Mughili Al-Mazouni, “The Sweetening of Gold in Judicial Science and Literature.””Tahlyyat Addhahab fi Ilm Al Qadaa walAdab” we discussed the following problem, which is, is this manuscript in our hands correct in relation to its author? Does this copy amount to producing the book as intended by its author or close to it? To answer this, we divided this research into two parts, the first; A study on the author and the book, in two chapters, each of which contained two chapters, and the second was the investigation section. In which we wrote the manuscript in modern writing and translated it to the media mentioned by the author as we attributed the texts of the issues to their sources, and finally we reached through it to some conclusions and recommendations, the most important of which are the emergence of eminent scholars like Abu Imran despite his contemporary to a period characterized by weakness due to wars and strife, and care must be takenof the books of jurisprudential calamities and their investigation, whether they are buried or those that have been investigated or those which need investigation.
