شھادة المرأة في الحدود والقصاص والتعزیرات -دراسة مقارنة بین الشریعة الإسلامیة والقانون الجزائري

Abstract

یعتبـــر البحـــث دراســـة عـــن الشـــهادة فـــي الشـــریعة الإســـلامیة مقارنـــة بالقـــانون الوضعي وكانت رغبتي بالكتابة في هذا الموضوع لبیان مـواطن الاخـتلاف والتشـابه بـین الشــریعة الإســلامیة والقــانون الوضــعي ، وبیــان قــدرة الشــریعة الإســلامیة علــى تحقیــق مصـالح العبـاد وصـلاحها لكـل زمـان ومكـان للبشـریة جمعـاء، وتمیـز الشـریعة الإسـلامیة في مسألة شهادة النساء ، حیث لم تقبل شهادة المرأة فـي الحـدود والقصـاص والتعزیـرات بـاء طـلاق، كمـا هـو الحـال بالنسـبة فـي القـوانین الوضـعیة الحدیثـة بـل قیـدها بمـا یتفـق مع طبیعة المرأة وفطرتها، وبما یحفظ الحقوق في نفس الوقت.
