جریمة السرقة دراسة مقارنة في الفقهي الإسلامي وقانون العقوبات الجزائري

Abstract

هذا البحث عبارة عن دراسة تحلیلیة مقارنة بین موقف القانون الجزائري وموقف الفقه الإسلامي من جریمة السرقة و تعرضت من خلال هذا البحث المتواضع، لتعریف السرقة والاختلاس في الفقه الإسلامي والقانون العقوبات الجزائري. ثم حاولت المقارنة بین التعریفین ثم تعرضت لأحكام السرقة وأركانها وشروطها في الفقه الإسلامي و القانون العقوبات الجزائري. ثم میزت بین جریمة السرقة والجرائم المشابهة لها في كل من الفقه الإسلامي والقانون العقوبات الجزائري. ثم عرجت بشيء من التفصیل على أركان جریمة السرقة والاختلاس في الفقه الإسلامي والقانون العقوبات. ثم تكلمت عن عقوبة السرقة في الفقه و القانون الجزائري ، ووسائل إثبات هذه الجریمة وصفة هذه العقوبة و الحكمة من إقامتها.~ 6 ~ Summary This research is a comparative analysis between the position of the law and the position of the Algerian Islamic jurisprudence from crime and theft have been through this research humble , the definition of theft and embezzlement in Islamic jurisprudence and the Algerian .
