Item أثر الاجتهاد المقاصدي في النوازل المالية المعاصرة(Universty of Eloued جامعة الشهيد حمة لخضرالوادي, 2023-01-19) حدد, فخر الدينالملخص: تشهد الساحة الفقهية في عصرنا الحاضر ظهور مستجدات عديدة متنوعة، ونوازل كثيرة متزايدة، مست مختلف جوانب حياة الناس، خصوصا في ميدان المعاملات المالية، وهو الأمر الذي استدعى نظر الفقهاء والباحثين المختصين من أجل بحث تلك النوازل؛ لإبراز نظرة الشريعة الإسلامية إليها وإصدار الأحكام الشرعية المناسبة لها. ومن سبل الاجتهاد التي سلكها علماؤنا في سبيل بحثهم للوصول لأحكام النوازل المالية المعاصرة: الاجتهاد المقاصدي الذي ينبني على مراعاة مقاصد الشريعة والالتفات إليها في العملية الاجتهادية، لا سيما عندما تعوزهم النصوص الخاصة المتعلقة بالنازلة محل البحث، وبذلك استنبطوا أحكاما كثيرة لنوازل عديدة مستندين إلى الكليات والقواعد المقررة في الشريعة الإسلامية. وقد تبين من خلال هذا البحث - عبر دراسة تأصيلية تطبيقية- أهمية الاجتهاد المقاصدي وأن له دورا بارزا في الحكم على القضايا والنوازل المستجدة في كل عصر، خصوصا عند فقدان النصوص الجزئية التي تخص النازلة المدروسة، فالنصوص متناهية والحوادث غير متناهية كما يقول العلماء، وذلك ما ظهر من خلال هذا البحث الذي عني بدراسة نوازل متعددة متعلقة بمسائل مالية متنوعة، بدءا بتعريفها ثم تكييفها الفقهي، وصولا إلى بيان الأحكام الفقهية المتعلقة بها، وانتهاء ببيان أثر النظر المقاصدي في الحكم عليها. وتندرج النوازل التي تناولها البحث ضمن مجالين مهمين، أولهما: مجال الزكاة، وثانيهما: مجال المصارف والأسواق المالية، وهما من أبرز المجالات المالية التي تشهد نوازل كثيرة في هذا العصر. Abstract : The jurisprudential arena in our present time is witnessing the emergence of many diverse developments, and many increasing calamities, affecting various aspects of people's lives, especially in the field of financial transactions, which called for the consideration of jurists and specialized researchers in order to discuss these calamities; To highlight the Islamic Sharia's view of it and issue the appropriate Sharia rulings for it.Among the ways of ijtihad that our scholars have used in their research to arrive at the provisions of contemporary financial calamities is the maqasidi ijtihad, which is based on observing the purposes of Sharia and paying attention to them in the process of jurisprudence, especially when they lack the special texts related to the calamity in question, and thus they devised many provisions for many calamities based on the faculties and rules prescribed in Islamic Sharia. It was found through this research that the importance of maqasidi ijtihad and that it has a prominent role in judging emerging issues and calamities in every era, especially when the partial texts that pertain to the studied calamity are lost. I am concerned with studying various calamities related to various financial issues, starting with their definition and then their jurisprudential adaptation, leading to the statement of the jurisprudential rulings related to them, and ending with the statement of the impact of intentional consideration in ruling on them. The calamities dealt with in the research fall within two important fields, the first: the field of zakat, and the second: the field of banks and financial markets, and they are among the most prominent financial fields that are witnessing many calamities in this era.
