Item آليات الحماية الدولية والوطنية للممتلكات الثقافية في القدس(جامعة الوادي University of Eloued, 2016-03-01) حوبه, عبد الغنيتتحدث هذه الدراسة القانونية عن الآليات المختلفة لحماية الممتلكات الثقافية في القدس وتبحث في فعاليتها من خلال قواعد القانون الدولي الإنساني، وذلك بإبراز دور الوسائل الدولية في هذا الصدد من تشجيع للتعاون الدولي والاتفاقيات الثنائية والتصدي للاتجار غير المشروع ومكافحته ثم تبين دور المنظمات الدولية الفاعلة كالأمم المتحدة عموما واليونسكو على وجه الخصوص باعتباره مختصا في مجال الثقافة والعلوم والصليب الأحمر الدولي وما يتضمنه فهو يمثل أحد ضمانات إنفاذ القانون الدولي الإنساني ثم نتطرق لدور الوسائل الإقليمية والمتمثلة في المنظمتين العربية والإسلامية للتربية والثقافة والعلوم وأخيرا الوسائل الوطنية المتمثلة في مؤسستي الأقصى للوقف والتراث والقدس الدولية لأجل معرفة مدى مواءمة التشريعات الوطنية الفلسطينية للصكوك والمواثيق الدولية من جهة، وفعاليتها في حماية الممتلكات الثقافية بالقدس من جهة أخرى. ABSTRACT: This legal study discusses the different mechanisms for the protection of cultural property in Jerusalem and Its effectiveness through the rules of international humanitarian law, by highlighting the role of international means in this regard from the promotion of international cooperation ,bilateral agreements and banning the illicit trade. The study also shows the role of the effective international organizations like the U.N and UNESCO, in particular, as a specialist in the field of culture, science and the I.C.R.C which represents one of the international humanitarian law enforcement guarantees, then, l address the role of the regional The role of the Arab and Islamic Educational, Cultural and Scientific Organizations. finally, I focus on the national means represented by the two institutions: Aqsa for wakaf and heritage , also the Jerusalem International ; in order to make the suitability between the Palestinian national legislations and the international conventions and instruments on one hand, and their effectiveness in the protection of cultural property in Jerusalem on the other hand.Item الاستصحاب عند الإمام ابن العربي من خلال كتابه: " المسالك في شرح موطأ مالك(جامعة الوادي University of Eloued, 2016-03-01) عبابة, الطاهريبدأ المقال بمقدمة تطرح إشكالا: كيف قَعَّــدَ ابن العربي لأصل الاستصحاب في كتابه المسالك؟ وكيف طبَّقَ وفَرَّعَ على قواعده (الاستصحاب) المختلفة؟ وللإجابة على الإشكال المرفوع، عالجت موضوع الاستصحاب من خلال استقراء قواعده، وأمثلة تطبيقية له من كتاب: "المسالك في شرح موطأ مالك" للإمام ابن العربي، بعد التعريف بإيجاز بابن العربي وكتابه المسالك، قَدّمْتُ للموضوع بتعريف الاستصحاب، وذكر أقسامه وحجيته في مبحث تمهيدي، ثم قسمت قواعد الاستصحاب إلى أربعة مباحث: قواعد تتضمن معنى اليقين، ومبحث آخر عن قواعد تتعلق بالألفاظ.أما المبحث الثالث: لقواعد تتعلق بحال الناس. ومبحث أخير: في قواعد تتعلق بالأبضاع والصفات والعقود. يبرز المقال عناية ابن العربي بالتقعيد والتأصيل -بشكل لافت في كل الكتاب-حيث برع ابن العربي في التقعيد بالاستصحاب، معملا العديد من قواعده. ABSTRACT: This article starts with an introduction explaining how Ibn Al Arabi established the foundation of accompanying in his book Al Massalek, and how he applied it and found derivations from its different rules. To answer the question posed, I discussed the rules of accompanying and some practical examples from Al Imam Ibn Al Arabi’s book Al Massalek. After a brief biography of Ibn Al Arabi and his book Al Massalek, I defined accompanying and discussed its branches and arguments in an introductory chapter. Next, I divided the rules of accompanying into four sections: rules dealing with certainty; a section dealing with the rules related to vocabulary; a third section devoted to the rules of the state of people; and a fourth section discussing the rules connected to vulvas, qualities and contracts. This article highlights the great importance that Ibn Al Arabi gave to the establishment of the rules and principles of accompanying –in all his book in a remarkable way. In fact, he managed to establish rules through accompanying, and provided many practical examples about that.Item القراءة المعاصرة للسنة النبوية " محمد شحرور أنموذجا(جامعة الوادي University of Eloued, 2016-03-01) بلعمري, أكرميستجلي هذا الموضوع قراءة معاصرة للسّنة النّبوية عند محمّد شحرور من خلال تتبّع أهمّ الرّؤى التّي يطرحها في كتاباته، خاصّة كتابه" السّنّة الرّسولية والسّنّة النّبوية"، باعتباره خلاصة آرائه تجاه السّنّة النّبوية، من خلال نقده للمفاهيم المسلّم بها، كوحيية السّنّة وحجيّتها ومفهومها وأقسامها وعدالة الصّحابة، ووضعه بدائل لقراءة السّنّة قراءة تليق بها، وهذا البحث محاولة جادة لمناقشة بعض هذه الآراء في هذه الورقات. ABSTRACT: This article, as is apparent from its title It addresses the crime of insulting the companions of the prophet God bless them by invoking Substances criminalizing This act and Discuss the types of punishment prescribed in this regard, as a sort of contempt of religion crimes.Item منزلة قول الإمام الهيثمي في كتابه مجمع الزوائد ومنبع الفوائد: رجاله ثقات " ونحوه (عرض ونقد(جامعة الوادي University of Eloued, 2016-03-01) قوفي, حميدهذا البحث - على وجازته- يعالج قضية مهمة في النقد الحديثي، لما ينبني عليها من الأحكام على الأحاديث الواقعة في كتاب مجمع الزوائد ومنبع الفوائد لأبي بكر الهيثمي رحمه الله، ولما كان هذا الكتاب مرجعا لكثير من المتأخرين في التخريج واعتماده في الحكم على الحديث كان لزاما التنبيه على ما وقع فيه من الخلل المنهجي- فيما بدا للباحث- مدللا في ذلك بأمثلة ومناقشة علمية، والبحث خاص بما حكم فيه الهيثمي بعبارة: "رجاله ثقات" ونحوها. Judgment " men are trustworthy" And the like especially in hisItem البنية الصوتية للغة العربية من الشعر الجاهلي إلى القرآن الكريم(جامعة الوادي University of Eloued, 2016-03-01) محلو, عادلممّا لا يُختلف فيه أنّ نزول القرآن الكريم حدثٌ تاريخيّ شديد الخطورة وبالغ الأهميّة في مسيرة البشرية عامّة، والجزيرة العربية خاصة؛ إذْ ولَّدَ تحوّلات جذريّة وتغيّرات عميقة في مختلف مناحي الحياة العربية. ولأنّ اللغة ظاهرة اجتماعيّة فقد كانت من أوجه الحياة العربية التي مسّها هذا التغيّر، ولم يقتصر ذلك على مستوى من مستويات الاستعمال اللغوي دون غيره، فشمل كلّ المستويات: الصوتي، الصرفي، التركيبي، والدلالي. والهدف من ذلك إرساء لغة القرآن مرجعا جديدا بدل لغة الشعر الجاهليّ التي كانت قمّة البيان العربيّ ومنوال الكلام الرفيع قبل نزول القرآن الكريم. ويسعى هذا المقال إلى رصد التطوّر الذي طرأ على البنية الصوتيّة للغة العربية من العصر الجاهلي إلى القرآن الكريم، وذلك من خلال فحص نصّيْن؛ الأوّلُ قصيدة لامرئ القيس عن الموت وجدوى الحياة والثاني سور: الطارق، التين، والتكاثر. والسؤال الأساس الذي يُطرَحُ بعد رصد التطوّر الصوتي هو: ما هي المسارات الجديدة التي فُتِحَت للغّة العربية بسبب ما أحدثته لغة القرآن الكريم من تطوّر في بنيتها الصوتيّة التي كانت في الشعر الجاهلي؟ ABSTRACT: The descent of the Holy Quranis a historic event very serious and very important in the human history ,In particular the Arabian Peninsula. He produced radical and profound changes in various aspects of Arab life. In order that Arabic language is a social phenomenon it has touched by this transition in all aspects " Voice, morphological, structural, and semantic " in order to establish the language of the Koran, as a new reference rather than the language of pre-Islamic poetry. This research seeks to follow the evolution of the acoustic structure of the Arabic language from the pre-Islamic era to the Koran through the examination of two texts :The first: Apoem by Imroo Alqais About death and feasibility of life. The second: Surat Attakather. The main question that appears after this evolution is :What are the new tracks caused by the language of the Koran for Arabic in the sound structure that has been in Pre-Islamic Poetry.Item التفسير المعاصر للقرآن الكريم وفق مرويات النزول "عرض ونقد(جامعة الوادي University of Eloued, 2016-03-01) رحماني, إبراهيملا يُعرف في تاريخ العالم كلّه- من لدن أرَّخَ الناس- كتاب، بلغت عليه الشروح، والتفاسير، والأقوال والمصنفات، ما بلغ من ذلك على القرآن الكريم، ولا شبيها به، ولا قريبا منه…" ولقد أسهم أعلام هذا العصر في تلك الجهود الخادمة لكتاب الله تعالى؛ فظهرت مئات المصنفات التي تنهل من هداية القرآن لينتفع بها المسلم المعاصر، وظهرت لمسات تجديدية على مستوى اللغة والأسلوب واختيار الموضوعات وتحليلها، وكان لتنوع المدارك ومستويات التدبر أثر عميق في انتشارها على أوسع نطاق. ومما انفرد به هذا العصر أن ظهرت تفسيرات للقرآن الكريم على خلاف المعهود من الترتيب المصحفي حيث اعتمدت على ترتيب النزول بالنسبة للسور؛ مما يطرح عدة تساؤلات عن مدى مشروعية هذا اللون من التصنيف المخالف للترتيب المصحفي وعن الجدوى منه، وكذا الآثار التي تنجم عنه، وهل يمس من قريب أو من بعيد بقدسية المصحف؟ وبناء عليه كان الاختيار لكتابة هذه الصفحات انطلاقا من تعريف التفسير إلى عرض جهود التفسير المعاصر للقرآن الكريم وفق مرويات النزول، وصولا إلى نقد الاتجاهات المعاصرة في التفسير وفق ترتيب النزول والخلوص لجملة من النتائج والتوصيات. ABSTRACT: It is not known in the history of the world that M A book been interpreted such as the interpretations of the holly KORAN. It was a notable contributions guided by The latecomers scientists in this regard .There were an innovative touches on the level of language, style and choice of subjects and analysis. This era has been distinguished by the interpretations of the Koran Unlike the usual Which hit relied on the order of descent ,Which raises several questions about the legality of this type of classification in regards to the sanctity of the Koran. Proceeding from this problematic, the choice was to write these pages In the definition of the interpretation up to the criticism of contemporary trends in the interpretation According to the order of descent, to arrive at a set of findings and recommendations.
