تتناول هذه الدّراسة النموذج السويدي الرائد في مجال تكافؤ الفرص بين الجنسين واستراتيجيات الدّعم والتعزيز للنساء خاصّة في مجال الحقوق السياسية والذي انعكس جليا من خلال التمثيل العالي للنّساء في المجالس المنتخبة وكذا تواجدها الكبير في أغلب مؤسّسات صناعة القرار السياسي. وكذا أهمّ الخلفيّات السياسيّة والقانونية والاجتماعية والتي كانت وراء التواجد العالي للنساء في مؤسّسات صناعة القرار السياسي وأهمّ العوامل والاستراتيجيات الدّاعمة لذلك، والتي جعلت من السّويد بلدا رائدا في دمج النساء في مؤسّسات صناعة القرار السياسي. الاستعجال الدّولي في حالة الأزمات

تهدف هذه الورقة إلى تسليط الضّوء على الأزمات الدولية، التي لها آثار وخيمة على المجتمع الدولي، تتطلّب منه التحرّك السّريع والمناسب وفق آليات محدّدة قانونا تكتسي طابع الاستعجال، سواء كان من خلال المنظّمات الدولية العالمية أو المنظمات الإقليمية أو حتى الدّول. وبالرّغم من كثرة الأزمات الدولية في الوقت الراهن، وهي أكثر من أن تحصيه هذه الورقة، غير أن هذه الورقة حاولت أن تستشهد بأزمتين دوليتين (بورما، وسوريا) تعتقد بأنّ لها أثرا بليغا في الجانب الإنساني منها. Abstract: This article aims to shed light on international crises, which have serious implications for the international community, It requires rapid and appropriate action in accordance with specific mechanisms of law as urgent as possible, whether through international and global organizations or regional organizations or even countries. Despite the large number of international crises at the moment, which are uncountable, but this article tried to cite two international crises (Burma, Syria) and believed that its eloquent impact on the humanitarian side.
السّياسة الديغولية تجاه الجزائر بين الأمس واليوم

تبنى التيار الديغولي-الذي وضع بصماته المميزة في الحياة السّياسية الفرنسية، منذ أربعينات القرن العشرين وإلى اليوم-، رؤية خاصّة به عندما تعلّق الأمر بالعلاقة التي تربط فرنسا والفرنسيين بالجزائر والجزائريين، هذه الرؤية يمكن تقسيمها إلى مرحلتين، قبل وبعد استرجاع السّيادة الوطنية، ففي المرحلة الأولى، كان سعي ديغول وتياره هو المحافظة على أرض الجزائر وشعبها تابعين للسّيادة الفرنسيّة، مستعملا مختلف الأساليب العسكريّة والسياسيّة لتحقيق هذا المبتغى، وعندما لم تنجح هذه المحاولات في الحفاظ على الجزائر تحت وصاية فرنسا، وتمكّن جبهة التحرير الوطني من استرجاع السّيادة الوطنيّة صيف سنة 1962، انتقلت الديغولية إلى تطبيق المرحلة الثانية في علاقتها بالجزائر، والتي قامت وما تزال على محاولة الاحتواء تارة، والبراغماتية والمصلحة التي تخدم بلادها غالبا. Abstract: The De Gaullism still held great impact upon the French political establishment since the 1940 ‘s of the last centry until now, particularly French’s political relationships with Algeria and the Algerians. This visions towards Algeria today, we could divided it into two step, and this before and after the Algerian independance.The first step De Gaulle and his political party were looking to keep Algeria undern his authority and power. And in order to keep ALgeria for France, his used all means, and methods, i.e. political, economical and military one.The second step come after the Algeria’s independance in 1962 .Witout a doubt the De Gaullism still working for its proper benefic and interest, in all levels: politically, economically and even.
المسؤوليّة الدستورية لرئيس الدولة في النظامين السياسيين الجزائري والأمريكي

أقرّ المشرّع الدستوري الجزائري بمسؤوليّة رئيس الجمهورية بسبب الخيانة العظمى في دستور 1966 على غرار المشرّع الفرنسي، وكذلك المشرّع الدستوري الأمريكي الذي جعل من الإتهام الجنائي (l’impeachment) آلية لتحريك مسؤوليّة الرئيس الأمريكي، إلاّ أنّ الفراغ التشريعي والغموض والعرف الدستوري وعقبات أخرى جعلت من المسؤولية الرئاسية فرضيّة على حدّ تعبير الفقه الدستوري تحتاج إلى أطر قانونية لتفعيلها وجعلها أداة لتوازن المؤسّسات وضمانة لاستقرار النظام السياسي، وعليه كان هذا البحث من أجل تحديد الآليات الدستورية لمسؤوليّة رئيس الجمهورية في دستوري الجزائر والولايات المتحدة الأمريكية، وتحديد صعوبات تطبيقها والحلول العملية لها. Abstract: The Algerian Constitutional legislator like the French legislator approved the responsibility of the President of the Republic because of high treason in the 1996 Constitution. As well as the American constitutional legislator who made the impeachment as a mechanism to move the responsibility of US President. However, the legislative vacuum, ambiguity, constitutional custom and other obstacles made the presidential responsibility a hypothesis, in the words of constitutional jurisprudence, needs legal frameworks to activate and make it a tool to balance institutions and a guarantee for the stability of the political system. Accordingly, this research was performed in order to determine the constitutional mechanisms for the responsibility of the President of the Republic in the constitution of Algeria and the United States of America and to identify their application difficulties and practical solutions to them. ال
آليات حماية الحريّات الأساسيّة بين التّشريع الجزائري والمواثيق الدّولية

إنّ حماية حقوق الإنسان والحريات العامّة مسألة داخلية بالأساس فرغم وجود حماية دولية للإنسان وحرياته الأساسية يظلّ تحقيق هذه الحماية منوطا بتطبيقها على الصعيد الداخلي، ونهدف من خلال هذه الورقة إلى مناقشة أهم آليات حماية الحريات الأساسيّة والتي تكفلها الدساتير والقوانين الوطنية، عن طريق ضمانات دستورية وضمانات قانونية، كما تلعب اللّجان سواء الوطنيّة أو الدولية دورا كبيرا في حماية هذه الحريات. Abstract: Protecting the human rights and public freedoms is an internal issue. Despite of the International protection of the human person to protect these rights, though they are needed to be implemented internally. In this paper, we aim at discussing the most important guarantees given by the Algerian constitutions and laws to protect these fundamental freedoms. Also we have the national and the international committees which play a great role in protecting these rights.
تعدّد الزوجات بين الحقّ والرّخصة في التشريعات الأسريّة المغاربية

يثور الخلاف في التشريعات الأسرية المغاربية في حكم التعدّد أو تكييفه القانوني: فهل هو رخصة لا يجوز اللّجوء إليها إلا إذا توافر موجبها؟ أم هو حقّ يكون للشّخص أن يستعمله دون قيد أو شرط إلاّ القيود التي قرّرها الشّرع؟ وبالرّجوع إلى الشّريعة الإسلاميّة نجدها منحت الرّجل حقّ الزواج بأربع نسوة، ولم تقيّده في ذلك إلا بالعدل بينهن. وهذا يعني أن فرض قيود أخرى على التعدّد عن طريق التشريع، أو وضع عقوبات تحول دون حقّ الرّجل بالزواج بأكثر من زوجة، لا يمكن أن يفهم إلا ّأنّه تطاول على الشّرع؛ بتحريم ما أحلّه الله. وخلاصة النّظر في هذه المسألة كما عالجتها التّشريعات ورصدها البحث التمييز بين اتجاهين: اتجاه يرى تقييد تعدّد الزوجات بتضييق إعماله؛ أي يجعله من قبيل الرّخصة التي لا يجوز استعماله إلاّ إذا توافر موجبها. ويعني ذلك أن التعدّد ليس حقّا للرجل وليس أصلا من أصول الشّريعة بل هو استثناء من القاعدة، لابدّ اخضاعه لرقابة القاضي. واتجاه ذهب إلى منع تعدّد الزوجات منعا مطلقا، بل اعتبره جريمة يعاقب عنها القانون. Abstract: Polygamy between right and permission in Maghreb family legislation Disagreement arises in legislation in the Maghreb family about pluralism whether it is permitted and not be resorted to only if the availability is afforded? Or is it the right of a person that is used without restriction or condition, but only the restrictions established the islamic law. The Islamic Sharia law has granted man the right to marry four women with no restrictions only justice among them. And this means the imposition of other restrictions concerning polygamy through legislation or impose sanctions to prevent the man's right to marry more than one wife, cannot be understood as an insult to the islamic law by prohibiting what Allah permitted. To summary of the issue, as dealt with by the legislations and exposed by the research combines The distinction between two opinions: The first considers restriction as a kind of permission, used only if the If positive availability is afforded, which means, this is not really that the poligamy to men is not a right and not originally from the assets of the sharia, but is an exception to the rule which should be subject to control by the judge. The second prevents polygamy considering it as a crime punishable by the law.
حماية الحقوق الثّقافية في زمن الحرب والنّزاعات المسلّحة

كثرت الحروب والنزاعات المسلّحة في وقتنا الحاضر، خاصّة بعد الثورات الإجتماعية التي اجتاحت البلدان العربية وما أفرزته من آثار سلبية على مجتمعاتنا وأفرادها، ومن مساس خطير بحقوق الإنسان جملة وبالحقوق الثقافية تفصيلا، وخاصّة التراث الثقافي الذي يعدّ ملكا للإنسانيّة جمعاء، ولهذا لابدّ من تفعيل المسؤوليّة الدوليّة وتحميلها الجهات المخلّة بأحكام القانون الدولي الإنساني سواء كانت الدّول، أو الحكومات، والتّنظيمات، والأفراد، ناهيك عن توقيع العقوبات الدوليّة التي قد تتدرج من التنديد إلى العقوبات الإقتصادية وصولا إلى الجزاءات العسكريّة. Abstract: Nowadays, wars and armed conflicts have increased especially after the social uprisings that devastated most Arab countries, causing a lot of negative effects upon social and individual levels, as well as severe harms to the human rights as a whole, and to cultural standards in detail particularly to the cultural heritage which is entirely human property, it is therefore as an absolute necessity to urge on the whole world responsibility in order to charge the deficient quarters with the international law disposition whether it be states Governments communities or individuals, and to apply gradual sanction from the strong objections to the effective economic sanctions and even to the military interventions.

التقييم أوّلا وقبل كلّ شيء عنصر مهمّ وأساسي لتطوير التعليم يسمح ويساعد على تحسين الجودة بشكل مستمر، ويشجّع على تطوير الكفاءة والفاعلية في منظومة التعليم العالي. تعالج هذه الورقة البحثية مسألة التقييم في نظام التعليم العالي المغربي والإصلاح الجديد تبعا لتوجّهات الميثاق الوطني للتربية والتّكوين، وصدور القانون رقم 01.00 المتعلّق بتنظيم التعليم العالي. فالتقييم وُضع في صميم تحديث نظام التعليم العالي في المغرب. Résumé: L’évaluation est avant tout un moyen, un formidable outil pour la valorisation de l’enseignement et l’amélioration continue de la qualité ,favorise le développement de l’efficacité, de l’efficience du système de l’enseignement supérieur. Ce papier discute la question de l’évaluation dans le système d’enseignement supérieur marocain ,et la nouvelle réforme, suite aux orientations de la Charte Nationale d’Education et de Formation et la promulgation de la Loi 01 - 00 portant organisation de l’enseignement supérieur. L’évaluation est placée au coeur de la modernisation du système de l’enseignement supérieur marocain.
