    محلّ الحكم وأثره على صفة الحكم واختلاف الفقهاء

    يعتبر محلّ الحكم من المصطلحات الرّئيسة التي يتعلّق بها الحكم إلا أنّها عند التّدقيق والنّظر ليست ظاهرة ولا محدّدة، لأنّ هذا المصطلح يتداخل أحيانا مع المناط والعلة والمناسبة. ولقد حاولت الباحثة ابتداء الوقوف على حقيقة المصطلح عند الأصوليين وتحديد مدلولاته لارتباطها بنوع الحكم التّكليفي وكذلك تحديد الفروق وتحديد أوجه الشبه بين المحل فواتا وثبوتا لرفع اللبس أثناء تكييف المسائل الفقهية ولقد تعرضت الباحثة لمسائل مهمة ذات صلة بالموضوع تتمثل في جواز التعليل بمحل الحكم،وانفرد البحث بالتعرض لأثر فوات المحل على صفة الحكم واعتباره من أسباب اختلافات الفقهاء. Abstract: The place of Islamic ruling is one of the main terms to which the provision relates, but when it is scrutinized and considered, it is neither apparent nor specific, because this term sometimes interferes with the: Appropriate Islamic governance , The hypocrites, reason . The researcher has tried to identify the truth of the term among the fundamentalists and determine its significance because it is related to the type of the caste rule as well as to identify the differences and identify the similarities between the shop and the doubts and the ambiguity to clarify the confusion while adapting the jurisprudential issues.
