    إثبات الزواج العرفي المتنازع فيه " دراسة مدعمة بالاجتهاد القضائي الجزائري "

    إذا وقع نزاع حول واقعة الزواج العرفي بين الزوجين، وكان أحدهما يدّعي قيام الزواج، والآخر يزعم نفيه ويطعن في قيامه أو في صحته، فإن الطريق الوحيد لإثبات ما يدّعيه المدعي هو إقامة دعوى إثبات الزواج أمام المحكمة المختصة، وإذا تمكن المدّعي من إثبات الزواج حكمت المحكمة بقيام الزواج. وتبحث هذه الصفحات في الوسائل التي يتم بها إثبات الزواج العرفي حال التنازع بين الطرفين، من خلال بيان مفهوم عقد الزواج العرفي، ثم عرض وسائل إثبات عقد الزواج العرفي. In the event of a dispute about the fact of Orfi marriages between couples, where one of them claims to prove the case of marriage, and the other denies this case, the only way to prove this case is to file a lawsuit to prove the marriage to a competent court.
