حماية اليتيم الجانح واليتيم الضحية في القانون الجزائي

لقد حمى المشرع الطفل في نصوص قانونية كثيرة، غير أن هذه القوانين التي رصدها المشرع لحماية الطفل الجانح والطفل الضحية تتناول بالحماية الطفل في الأوضاع العادية. ومن هنا نتساءل عن مدى تحقيق النصوص المذكورة الحماية الكافية للطفل في الأوضاع الاستثنائية كحالة اليتيم. ثم النظر في الوضع الاستثنائي لليتيم الجانح واليتيم الضحية وما يتطلبه من عناية خاصة من قبل المشرع. The legislator has provided legal protection for children in many texts, but these laws are observed by the legislature to protect the child delinquent and the child victim dealing with child protection in normal conditions. Therefore, we wonder about the extent to which the texts cited adequate protection of the child in the special situation as a case orphan. The paper deals with the consideration of the exceptional situation of the orphan delinquent and orphan victim, and what it requires of special attention by the legislator.
الإمام أبو داود سليمان بن نجاح اختياراته في مسائل الضبط القرآني من خلال كتابه أصول الضبط وما جرى به عمل المصاحف من أول الكتاب إلى أحكام ضبط النون الساكنة

كانت الكتابة الأولى للمصاحف في عهد الصحابة رضوان الله عليهم دون نقط ولا شكل، وفي آخر زمن الصحابة رضي الله عنهم زيد في المصحف النقط، فوضعت الحركات، من طرف أبي الأسود الدؤلي في نقطه المدور، ثم من طرف الخليل بن أحمد الفراهيدي في نقطه المطول، وهذا فيما يخص نقط الإعراب، وكذا نقط الإعجام الذي هو نقط الحروف، الذي ينسب ليحيى بن يعمر ونصر بن عاصم. وهكذا تتابع العلماء في وضع علامات لضبط الكلمات القرآنية، من أجل التيسير على الناظر في المصحف الشريف، وكان بينهم اختلاف في كثير من علامات الضبط. والبحث يتحدث عن إمام من أئمة الأندلس الكبار، يعرف بشخصيته، وحياته العلمية، ويبين مكانته وثناء العلماء عليه وعلى كتبه، ويعرف بكتابه الذي ألفه في علم الضبط القرآني، وهو من أصول هذا الفن. هذا الإمام هو أبو داود سليمان بن نجاح، ألف كتابه: أصول الضبط، بين فيه كيفية شكل الكلمات القرآنية، وأورد فيه خلاف العلماء ومذاهبهم في ذلك. ويعرض البحث كذلك لاختيارات هذا الإمام في ضبط الحروف والكلمات القرآنية، مبينا أسس اختياره، وما عليه عمل المصاحف اليوم. So scholars placed marks to adjust the Koranic words, in order to make them easier for the viewer in the Holy Koran, and among them was a difference in many marks of vowelization. The research talks about a great imam of the imams of Andalusia who is known his personality, and his scientific career, and it shows the stature and scholars praise on him and his books. He is known by his book that he composed in Koran science and it is one of origins of this art. This Imam is Abu Dawood Sulaiman bin Najah. He composed his book: Origins of vowelization and its method on the shortness. He showed the way of diacritic of the Koranic words, and he cited the dispute of scholars and their doctrines in it, with justification. The research also displays the choices of this imam in vowelizing the letters and the koranic words showing the foundations of his choice and copies of the Koran work today.
معالم لقراءة المعهود الفقهي في ميزان مقاصد الأحكام

إن قراءة الخلف لما تركه السلف تحتاج إلى معالم يفرضها تغير الزمان واختلاف المكان وتبدّل الأحوال، معالم تحفظ للموروث الفقهي مكانته ولمؤلفيه قدرهم، وللشريعة استمرارها؛ ذلك أن جنس المصلحة معتبر في عموم الأحكام الشرعية عند أئمة الفقه وأصوله قديما وحديثا، ومراعاة المقاصد والمآلات مع التزام ظواهر النصوص يحتاج إلى موازنة ومقاربة. كما أن إهمال الواقع الذي يعيشه الناس مكابرة، والمصلحة شريعة والشريعة مصلحة، وحتى تكون قراءة النص الشرعي مثمرة ونافعة، والمعهود الفقهي القديم مفعَّل ومتجدّد، ثم يضبط الحديث منه بالضوابط والقواعد ذاتها، لابد من موازنة بين منطوق النص ومدلوله، وبين الاجتهاد الفقهي وتغير الزمان والأحوال، إذ الجمود على المنقولات معيب، وعدم ضبط الاجتهاد مريب. Parameters for Interpreting the Conventional Jurisprudence in the Scale of provisions’ intentions Descendants' (followers') interpretations of what was written or left by their predecessors requires some parameters imposed by changes and differences in time, space and circumstances, which save the jurisprudent heritage, its stature, and the continuity of religious law (Sharia). What is worth mentioning here is the type of interest or profit of juridical provisions, according to both traditional and modern juristic scholars, is of great significance. Additionally, considering the objectives and consequences, and the compliance with the integral meaning of texts requires equilibrium and asymptotical approaching. Moreover, the interpretation of texts should not ignore the time and the circumstances that we live in; this is because interest (profit) and jurisprudence can be interchangeable. Now, in order to attain a fruitful and profitable interpretation of religious texts, and the conventional jurisprudence involved and renewable, but constrained by the same rules, we need to set equilibrium between literal and pragmatic meaning of texts, and between judicial discretion and changes in time and space. This is because inflexibility towards what was handed down to us is not desirable; at the same time, the failure to restrain judicial discretion is unconvinced. This is, of course, what this research intends to achieve
ضوابط الاستدلال بالقواعد الفقهية على النوازل المعاصرة

يعالج هذا البحث مسألة زرع الأعضاء التي وقع الخلاف بين أهل العلم المعاصرين بشأنها، من خلال بيان ضوابط الاستدلال بالقواعد الفقهية بشأنها، انطلاقا من مبحث الاستدلال بالقواعد الفقهية على النوازل، ثم عرض القواعد الفقهية المستدل بها على زرع الأعضاء، وأخير بيان ضوابط الاستدلال بالقواعد على جواز زرع الأعضاء. This research deals with the issue of organ transplant that occurred dispute on them among contemporary scholars, through statement inference controls by jurisprudential rules, on the basis of inference by jurisprudential rules on the new doctrinal issues. It also deals with the rules of jurisprudence relied upon in organ transplants. Finally, it shows the inference controls by the rules on the permissibility of organ transplants.

In recent times of human life, It has spread many kinds of deadly toxins that are called drugs. There are various aspects of the use of these toxins, Some of them became addicted to take it, others made it a way to profit by promoting and trafficking. Generally, these toxins has been a significant impact on the threat of human life, And it has influenced a direct impact on the five basic necessities stipulated by Islamic law (Charia). So it is necessary to identify the doctrinal rule of these toxins and related activities, as well as its punishment in Islamic jurisprudence.
منهج تَدْوِينِ النَّوَازِلِ الفِقْهِيَّةِ عند عُلَمَاءِ الجَزَائِرِ

لقد اعتنى فقهاء القطر الجزائري بالتدوين والتأليف في النوازل الفقهية؛ وهي المستجدات التي كانت تنزل بالناس فيجدون فيها عنتا ومشقة وتحتاج إلى إجابة من المجتهدين والمفتين، ومن العلماء الذين برزوا في هذا المجال الفقيه أبو زكريا يحيى المازوني في كتابه الدرر المكنونة في نوازل مازونة، والفقيه أبو العباس الونشريسي في كتابه المعيار المعرب، وكذا فتاوى ابن زكري وفتاوى المشذالي؛ وقد اتسمت هذه النوازل بالواقعية ومراعاة أعراف وأحوال وبيئات المستفتين، وامتازت كذلك بالتأصيل العلمي للفتوى واستثمار الفكر المقاصدي الذي وظفه فقهاء المالكية، فبقي على الباحثين المعاصرين واجب التنقيب والبحث في التراث العلمي للأجداد حتى نبني صرح مستقبلنا بالعلم الأصيل والبحث الفقهي الرصين، ونوجِّهَ نَشَاطَنَا العِلْمِي واهتمامنا الثقافي وجهة سليمة لنحقق النهوض الثقافي المنشود لأمة الاستخلاف. حكم الوصية بالتبرع بالأعضاء في الفقه والقانون

فقد تطورت عمليات زرع ونقل الأعضاء البشرية، تطورا ملحوظا خلال النصف الثاني من القرن العشرين، محققة بذلك نجاحات باهرة، الأمر الذي استدعى البحث عن الحكم الشرعي والقانوني لهذه العمليات والضوابط التي تحكمها. ونشطت على المستوي الشرعي المجاميع الفقهية والمؤتمرات الدولية التي عقدت لهذه الظاهرة، مما شجع التشريعات في بعض الدول على تنظيم ذلك في نصوص قانونية، خاصة فيما يتعلق بوصية التبرع بالأعضاء بعد الممات.لذا سعيت البحث عن حكم الوصية بالتبرع بالأعضاء في الفقه والقانون. ولدراسة الموضوع، ارتأيت أن أعالجه في ثلاثة مباحث أساسية، نعرض في المبحث الأول: تحديد مصطلحات البحث، وفي المبحث الثاني حكم الوصية بالتبرع بالأعضاء البشرية فقها وقانونا، أما المبحث الثالث فخصصته لشروط وضوابط الوصية بالتبرع بالأعضاء. Human organ transplants have evolved a remarkable development during the second half of the twentieth century, these processes have achieved remarkable successes, which has necessitated to look for legitimate and legal provision of these processes and its controls that govern them. International conferences and doctrinal groups have been held in order to study this issue, which has encouraged some countries to regulate it in legal texts, particularly with regard to the testaments of organs donation after death. This issue has been treated through three basic sections, the first: the identification of search terms, the second related to ruling on testaments of organs donation in jurisprudence and law, and the third relates to the conditions and controls of testaments of organs donation.
إجراءات منح القرار المتعلق برخصة البناء

هناك حلقة مفقودة في العملية الإدارية حيث أن القوانين والتنظيمات التي تنص على تنظيم النشاط العمراني موجودة، نحو (تنظيم الرقابة الإدارية لأشغال البناء وفرض احترام أدوات التعمير) والمكلف بتطبيق هذه القوانين محدد وهي السلطة الإدارية والإجراءات التي تطبق على المخالفين في ميدان البناء والتعمير معروفة لديهم، إلا أنه ورغم كل تلك فظاهرة البناءات الفوضوية والاستيلاء غير الشرعي للأراضي مستمرة فالحلقة المفقودة في تطبيق القوانين على المخالفين، فالواقع يثبت الوضع الغير سليم الذي آلت إليه الأوضاع في هذا المجال، جراء عدم الصرامة في تطبيق القوانين على المخالفين. مراعاة مصلحة المحضون بين مقتضيات الأحكام الفقهية والممارسة القضائية

إن حضانة الطفل واجبة ما دام الولد في أمس الحاجة إلى الرعاية والعناية، حيث يكون عاجزا عن مباشرة مصالحه بنفسه، ولا يميز بين ما يضره أو ينفعه. وتقتضي المصلحة الاجتماعية حماية الطفل وتقرير أحكام متماشية ومصلحته؛ ولهذا حرصت الشريعة الإسلامية وكذا القوانين المختلفة على وضع الشروط والضوابط التي تضمن حماية مصلحة الطفل المحضون، وعلى ضوء تلك الأحكام جاءت الممارسات القضائية. وفي هذه الصفحات تبيان لأحكام مراعاة مصلحة المحضون نظرية وتطبيقا من خلال ثلاثة مباحث؛ تطرق الأول إلى تعريف الحضانة، مشروعيتها، وتكييفها الفقهي؛ وبحث الثاني في مصلحة المحضون، مفهومها، خصائصها، وتقديرها. أما الثالث فخصص لعرض تطبيقات قاعدة مراعاة مصلحة المحضون في الفقه والقضاء. Child custody is obligatory as long as the boy in urgent need of care and attention, where he is unable to direct his own interests, and he does not distinguish between what harm him or help him. Islamic law has been keen as well as the various laws to establish the conditions and controls that ensure the protection of the interests of the child custody, judicial practices came in the light of those provisions. This research shows the provisions of the child taking into account interest of the child custody through three sections. The first relates to the definition of custody, and its legitimacy. The second related to interests of the child custody, its concept, its characteristics, and its appreciation. The third is related to the applications of the base taking into account interests of the child in jurisprudence and judicial practice.
