    تقييم واقع الهيئة الوطنية للوقاية من الفساد ومكافحته

    تحاول هذه الدراسة إبراز دور الهيئة الوطنية للوقاية من الفساد ومكافحته، وتقييم دورها وتحديد أهم العراقيل التي تعترض عملها بالإضافة إلى اقتراح الحلول والبدائل لتعزيز دور الهيئة في مكافحة ظاهرة الفساد. حيث تطرقنا في هذه المقالة إلى محورين أساسيين الأول يتطرق إلى استقلالية الهيئة الوطنية للوقاية من الفساد ومكافحته ، أما المحور الثاني يتطرق إلى محدودية دور الهيئة الوطنية للوقاية من الفساد ومكافحته. Abstract This study attempts to highlight the role of the National Commission for the Prevention and Control of Corruption, assess its role and identify the most important obstacles to its work, as well as propose solutions and alternatives to enhance the role of the Commission in combating corruption. In this article we discussed two main axes: the first deals with the independence of the National Commission for the Prevention and Combating of Corruption; the second focuses on the limited role of the National Commission for the Prevention and Control of Corruption.

    المسؤولية السياسية والجنائية للوزير الأول في النظام السياسي الجزائري

    تعتبر المسؤولية السياسية مبدأ وركن أساسي في الأنظمة السياسية المعاصرة، وهذا لتحقيق مبدأ التوازن بين السلطة التنفيذية والتشريعية، والجزائر كسائر الدول تنص على مساءلة الوزير الأول سياسياً وجنائياً بشأن أعمال يرتكبها الوزير أثناء أو بصدد تأدية أعمال وظيفته، ويتعرض الوزير بصفته الوظيفية للمسؤولية المزدوجة أمام كل من رئيس الجمهورية والبرلمان، والجنائية أمام المحكمة العليا كما نص أخر تعديل دستوري لعام2016.Political responsibility is a fundamental principle in contemporary political systems. It helps achieving the principle of balance between executive and legislative power. Algeria, like all other countries, provides for the political and criminal accountability of the Prime Minister for acts he/she committed during his/her mandate. The Prime Minister is e exposed to be questioned by President of the Republic and Parliament, and criminal the Supreme Court as stipulated in the last constitutional 2016 amendment.

    تناولت هذه الدراسة طبيعة عقوبة التشغيل الاجتماعي كأحد العقوبات البديلة في التشريعات المقارنة، حيث تطرق الباحثان إلى ماهية عقوبة التشغيل الاجتماعي من حيث مفهومها وخصائصها وأصل الفكرة، بالإضافة إلى فلسفة تلك العقوبة وتأثيراتها، كما تطرق الباحثان إلى احكام عقوبة التشغيل الاجتماعي في التشريعات المقارنة والإجراءات التي تتبع عنج تنفيذ عقوبة التشغيل الاجتماعي، وقد توصل الباحثان إلى أهمية تطبيق وتفعيل عقوبة التشغيل الاجتماعي لما تحققه من فائدة بالنسبة للمحكوم عليه والمجتمع ...This study deals with the nature of the of social employment penalty as one of the alternative penalties in the comparative legislations, The researchers focus on the the concept of social employment penalty from many aspects like its concept, characteristics, the origin of the idea, in the addition to the philosophy of the punishment and its effects, The researchers also discussed the provisions of the social employment penalty in the comparative legislations and the procedures that are followed in the implementation of social employment penalty. The researchers concluded to the importance of applying and activating for social employment penalty for the benefit it achieves for the convicted person and society.

    دراسة تحليلية للآليات المقررة لحماية الأسرة في التشريع الجزائري صندوق النفقة نموذجا

    الملخص على الرغم من توطيد مكانة المرأة في المجتمع الجزائري ، غالباً ما تجبر النساء المطلقات الحاضنات خاصة على التردد على أروقة المحاكم بين الفينة والأخرى آملة الحصول على نفقة أولادها، لكن دون جدوى ، كما ترك الإفلات من العقاب بالنسبة للمتعنت والممتنع عن دفع النفقة تساؤلات دون إجابة. والمشرع، حاول إيجاد حل لضمان النفقة غير المدفوعة ... مما أثار جدلا كبيرا في أوساط المجتمع عن مدى نجاعة هذه الآلية ، وبعد مدة أقر كل من مجلسي الأمة والبرلمان، مشروع هذا القانون فدخل صندوق النفقة رسميا حيز النفاذ. بعد نشره مؤخراً في الجريدة الرسمية ووضع إجراءات لفائدة الرسوم المالية. بموجب القانون رقم 15-01، بتاريخ 4 يناير 2015، و تم تجهيز الترسانة القانونية بآلية جديدة لحماية القاصرين والنساء المطلقات الحاضنات. وهذا ما يجعلنا نتساءل ما هي أفضل الممارسات التي يقدمها صندوق النفقة لتحقيق أهداف الحماية وفقا لقيم الكرامة والعدالة الاجتماعية. الكلمات المفتاحية : أسرة ، صندوق النفقة ، الحماية ، الآليات . Abstract Despite the consolidation of the status of women in Algerian society, divorced women often drag themselves into the workings of the courts. Just as impunity leaves the record of child support unanswered. The legislator, sensitized on this subject has just made a big decision: creation of a guarantee fund for unpaid alimony payments. After having provoked a strong controversy, within the society and after having been adopted by both Houses of Parliament, The alimony fund to protect the family and minor children officially entered into force after its recent publication on the Official Journal and the definition of procedures to benefit from royalties procedures. Pursuant to Law No. 15-01 of 4 January2015, establishing the alimony fund, the legal arsenal has been reinforced with a new mechanism for the protection of minors and divorced women exercising the custody rights which now benefit from support in the event of dereliction by the debtor.     ملخص: تتناول هذه الورقة البحثية بالدراسة مبدأ الأمن القانوني، بوصفه أحد المتطلبات الأساسية الراهنة لإرساء دولة القانون القائمة على ضمان حماية فعلية للحقوق والحريات الأساسية في المجتمع، لاسيّما في ظل الوضعية الحالية للقانون، والمتميزة بتضخم النصوص المعيارية، عدم استقرارها وتراجع جودتها التحريرية. وتهدف الدراسة إلى تأصيل المبدأ، من خلال التركيز خاصة على مضمونه، وعلى قيمته ضمن هرم تدرج القواعد المعيارية في الدول. Abstract: This research paper examines the principle of legal security, as one of the basic prerequisites for establishing a state of law based on ensuring effective protection of fundamental rights and freedoms in society, especially in light of the current situation of the law, characterized by inflation, instability and decline in editorial quality normative texts.     القيود الواردة على سلطة رئيس الجمهورية في اعلان ورفع حالة الطوارئ في الجزائر

    انطلاقا لما يحوزه هذا الموضوع من أهمية بالغة لتعلقه بسلطات رئيس الجمهورية في إعلان حالة الطوارئ من جهة ، ولارتباطه بحقوق وحريات الأفراد المكفولة بموجب المواثيق الدولية و أحكام الدستور التي تحضر كل أنواع الممارسات التي من شانها تقييد ها أو مساس بها من جهة أخرى ،غير أن عدم مراعاة ذلك في ظل الظروف الاستثنائية وبالخصوص في حالة الطوارئ التي يتاح فيها لسلطة التنفيذية السلطة التقديرية الواسعة في اتخاذ كل ما يلزم من تدابير و إجراءات ولو على حساب اختصاص غيرها من السلطات ، تحت ذريعة حماية النظام العام و بالتالي تبجيله على حقوق وحريات الأفراد ، و بالأخص في ظل غياب ضوابط قانونية ملزمة تضمن حماية فعلية لها كما فعلت بعض التشريعات المقارنة ما يجعلها عرضة لتعدي والانتهاك ، ما يفرض ضرورة إعادة النظر في الأمر بوضع ضوابط كفيلة لتحقيق الهدف المنشود بحماية الحريات و تحقيق التوازن بينها وبين السلطة . Abstract: from the great importance of this subject through hits attachment to the powers of the Presidents of the Republic with regard to the declaration of the state of emergency on the one hand, and its connection with the rights and liberties of individuals guaranteed by the international charters and the provisions of the constitution which prohibit all practices that limit or touch them, but the non consideration of this in exceptional circumstances and especially the case of emergency in which the executive power gives itself the power to take all measures and procedures, even if this is to the detriment of other powers under the pretext of preserving and glorifying the general order against the rights and liberties of individuals, especially in the absence of control obligatory legal systems which provide real protection, as some similar legislations has done, puts them in danger and makes them an object of violation, so it is necessity to review this case and to put effective constraints on achieving the desired object to protecting liberties and achieving a balance between them and the power. Résumé: à partir de la grande importance que porte ce sujet à travers son attachement aux pouvoirs du présidents de la république en ce qui concerne la déclaration de l'état d'urgence d'une part, et par sa liaison avec les droits et libertés des individus garantis par les chartes internationales et les dispositions de la constitution qui interdisent toutes les pratiques qui les limitent ou les touches d'autre part ,mais la non prise en considération de cela dans des conditions exceptionnelles et surtout au casd'urgence dans lequel le pouvoir exécutif se donne le pouvoir discrétionnaire à prendre toutes les mesures et procédures même si cela est au détriment des autres pouvoirs sous prétexte de préserver et de glorifier l'ordre général à l'encontre des droits et libertés des individus et spécialement en l'absence des contrôles légales obligatoires qui en assurent une vraie protection ,comme ont fait quelques législations semblables , les mets en danger et les rend un objet de violation ,ce qui pousse à la nécessité de revoir cette affaire et de mettre des contraintes efficaces à réaliser l'objectif voulu par la protection des libertés et la concrétisation de l'équilibre entre elles et le pouvoir.

    إذا كانت الدول اليوم على اختلاف أنظمتها السياسية تعيش مرحلة من المراجعة الشاملة للمنظومة التشريعية للإصلاح الإداري، فإنها لا شك تبذل غاية الجهد من أجل الاقتراب أكثر من المواطن وتلبية حاجاته العامة، ويتأثر مدى إتساع الصلاحيات والإختصاصات الموكلة للهيئات المحلية وخاصة البلدية بالمعطيات السياسية والإقتصادية والإجتماعية السائدة بالدولة، حيث يمثل رئيس البلدية في النظامين السياسيين الجزائري والتونسي أحد الركائز الأساسية في تعزيز وتطوير التنمية المحلية، كما يمثل المسؤول الأول في البلدية مظهر من مظاهر تكريس مبدأ الديمقراطية للقيام بالدور المنوط به ما لم تكن له من الإستقلالية القانونية والمادية فما يسمح له بتحقيق ذلك، خاصة وأن الأمر يتعلق بمهام معقدة ومتشعبة وبمجالات وميادين مختلفة في الاقتصاد والموارد المالية والمجتمع والثقافة والبيئة وغيرها. Abstract If the states today, with their different political systems, live a stage of an overall review of the legislative system for the administrative reform, they undoubtedly will make their maximum effort for more approaching the citizen and meeting his needs. The terms of reference of the local bodies, especially the municipality, are affected by the political, economic, and social data of the state where the mayor in the Algerian and Tunisian systems represents one of the main bases of enhancing the local development. Also, the first responsible in the municipality represents one of the features of setting up the principle of democracy for doing his role with the legal and financial independence that allows him to realize it, especially that it is related to complex tasks that are filled with different fields and domains in economy, financial resources, society, culture, environment, and so on.
