التفسير اللغوي للنص القرآني - جدلية الاستثمار والاستغلال

هذا المقال بعنوان: التَّفسير اللُّغويُّ للنَّصِّ القُرآنيِّ - جدليَّة الاِستثمار والاِستغلال -. وهو دراسةٌ في إشكاليَّة توظيف التفسير اللغوي لنص القرآن الكريم، في مُدونات التفسير التراثية، وكشفٌ لأنماط تعامل المفسرين مع هذه القضية؛ إذ أن المتأمل في هذه المسألة، يتَّضح له توجُّهان بارزان في توظيفها: توجُّهٌ ينطلق من المحتملات اللغوية في النص القرآني ليصل إلى بيان معناه؛ فهي نقطة البداية عنده. وتوجُّهٌ يعكسُ الأمر؛ فينطلق من المُقرَّرات العقديَّة، ويوظِّف إمكانات اللغة وسَعتها في تأويل النص القرآني لنُصرة ذلك المقرَّر العقديِّ، فهي نقطة النهاية عنده. ولمعالجة هذا الإشكال؛ بنيتُ أركان المداخلة على مقدِّمةٍ، ومقصدين وخاتمة. أمَّا المُقدِّمةُ؛ فقد تم فيها تحرير الإشكال الَّذي يطرحُه الموضوع، وبيان بعض القضايا التي ينبني عليها البحث؛ من قبيل: أهمية اللغة العربية للمفسر، وضوابط الاعتماد على اللغة في التفسير. وأمَّا المقصد الأوَّلُ؛ أثر التأويل اللغويِّ في اختلاف المفسرين؛ فيمثِّل الجانب الإيجابي في استثمار التفسير اللغوي، وهو ما يُطلق عليه بعض أهل الشَّأن: اختلاف التنوع، أي تكثير المعاني والدلالات للنص الواحد، دون تعارض أو مناقضة. وأمَّا المقصد الثَّاني؛ استغلال التأويل اللغويِّ للانحراف بالتفسير؛ فيمثل الجانب السلبيَّ من القضيَّة؛ إذ يُصبح التأويل اللغوي تابعًا لا متبوعًا، يُلوى عُنُقه ليُوافق مقصُودَ المؤوِّل. وقد توصلتُ في الخاتمة إلى نتائج أهمُّها: أن اللغة العربية على أهميتها لا تستقل بإدراك التفسير، بل الاعتمادُ عليها بمجردها يُعتبر من موارد الخطأ في التفسير. وأن أسلم طريق مُوصلٍ إلى نتائج علمية صحيحة في التفسير؛ هو الانطلاق من النص القرآني ذاته، لا من المُسَلَّمَات القبلية. This paper entitled "The Linguistic Interpretation of the Qur'anic Text-The Dialectic of Investment and Exploitation" dives into the issue of employing the linguistic interpretation of the text of the Holy Qur'an in the traditional interpretation records ; and tries to reveal the different patterns of interpreters dealing with this issue. Two prominent trends in the use of linguistic interpretation of the Qur'anic text become clear to the contemplator of this issue. An orientation that starts with the linguistic potentials in the Qur'anic text to reach a statement of its meaning. In this case, the linguistic interpretation is the starting point of this trend. And an attitude that reverses the equation by starting from the doctrinal decisions and employing the potentials of the language and its capacity to support those doctrinal decisions which are this trend's end point. To address this issue, this paper is designed in the form of an introduction , two chapters , and a conclusion. In the introduction, the studied problem is thoroughly presented and some of the cases on which the research is built are elucidated such as the importance of the Arabic language to the interpreter and the regulations that govern the dependency on Arabic in the process of interpreting . The first chapter –The Impact of Linguistic Interpretation on the Variation of Interpreters- provides an insight into the positive side of investing in the linguistic interpretation, which is what people in the field call: the difference of diversity, that is; the multiplication of meanings and connotations of the same text without conflict or contradiction. The second chapter –The Exploitation of Linguistic Interpretation in Deviating the Interpretation- introduces the negative side of the issue where the linguistic interpretation becomes subservient to the interpreters who twist it to match their intent. Lastly, the conclusion exhibits the most important results : 1. The Arabic language, despite its importance, is dependent on the comprehension of the interpretation ; rather, relying on language by itself is considered one of the sources of error in interpretation. 2. And the safest way to correct scientific results in interpretation is to start from the Qur'anic text itself, not from the axioms

تعقبات القاضي ابن عبد البر على أهل الظاهر في كتابه الاستذكار ( باب المعاملات) Judge Ibn Abd al-Barr's Followings up of Zahirites in his Book Entitled Al-Istithkar الملخص أوجدت حالة المنافسة المذهبية في الأندلس صورا من المناظرات والمناقشات والتعقبات بين السادة المالكية والسادة الظاهرية كان للحافظ ابن عبد البر(ت463ه) القدح المعلى فيها خاصة أنه عاصر في حياته ابن حزم الظاهري (ت456ه) الذي حمل لواء المذهب الظاهري في الأندلس وأبلى بلاء حسنا في الدعوة له، والرد على مخالفيه. إن دراسة التعقبات توفر رحابة للتفقه والنظر، وفرصة للمقارنة والتدبر فهي في مجملها مناظرة مفتوحة يحاول كل فقيه فيها إثبات صواب رأيه بالدليل والبرهان، والحجة والبيان. وتميزت تعقبات ابن عبد البر للظاهرية بعدم ذكر أسماء علمائهم إلا إمامهم داود، واستعمل في تعقباته ألفاظا تدل على السماحة قياسا بألفاظ من عاصره من الظاهرية. و انحاز الإمام ابن عبد البر إلى المشهور من مذهب الإمام مالك في ترجيحاته ذاكرا الدليل موضحا الدلالة معقبا على رأي الظاهرية بما يؤكد مجانبته للصواب . الكلمات المفتاحية : ابن عبد البر، الاستذكار، الظاهرية، التعقبات. Judge Ibn Abd al-Barr's Followings up of Zahirites in his Book Entitled Al-Istithkar abstract The state of sectarian competitiveness in Andalusia created forms of debates, discussions and follow-ups between the Malikis and the Zahirites. Al-Hafiz Ibn Abdul-Barr (d. 463 AH) had the upper hand in it, especially that he was a contemporary of Ibn Hazm al-Zahiri (d. 456 AH), who carried the banner of those scholars who stuck to the surface reading of the verses of the holy Quran and the prophet's saying in Andalusia and did a good job in defending and calling people for Islam, and he successfully responded to the opponents of Islam. The study of followings up (tracings) provides a space for jurisprudence and consideration, and an opportunity for comparison and reflection. In their entirety, these followings up constitute an open debate in which every jurist tries to prove the supremacy of his opinion citing evidences, proofs, and arguments. Ibn Abd al-Bar’s tracings of al-Zahiriyah were distinguished by not mentioning the names of their scholars except for their imam Dawood, and he used in his followings up words that indicate tolerance in comparison with the words of his contemporaries from al-Zahiriyah .And Imam Ibn Abd al-Barr sided with the well-known view of Imam Malik in his weighings, mentioning the evidence, explaining the significance, and commenting on the opinion of the Zahirites, confirms that they were mistaken in their judgements. الأمن الأسري زمن النزاعات المسلحة من خلال قواعد الشريعة الإسلامية والقانون الدولي الإنساني

تتناول هذه الدراسة موضوعا مهما يتعلق بأمن الأسرة من خلال قواعد النزاعات المسلحة في الشريعة الإسلامية والقانون الدولي الإنساني؛ حيث يوجد العديد من المبادئ والوسائل المهمة التي تؤسس لأمن الأسرة وتدعم حمايتها واستقرارها، ولعل من أهم هذه المبادئ مبدأ التمييز ومبدأ الإنسانية وكذلك صيانة الحرمات، أما الوسائل فإنّ منها ما هو عام كالالتزام بتعليمات قواعد النزاعات المسلحة ونشرها واحترامها والأخذ بالتدابير الوقائية وأعمال الإغاثة، ومنها ما هو خاص كحفظ الأسرة من التفكك وجمع شملها بعد التشتت وحماية السكن العائلي، ومراعاة الخصوصية لبعض أفراد الأسرة، وكانت أهم النتائج المتوصل إليها، أن الأسرة الأسرة كيانا مهما جدا وجب الاهتمام به في كل الظروف، سواء حال الحرب أو السلم. This study deals with an important topic related to family security through the rules of armed conflicts in Islamic law and international humanitarian law. Where there are many important principles and means that establish family security and support its protection and stability, and perhaps the most important of these principles is the principle of discrimination and the principle of humanity as well as the maintenance of sanctities. It is special, such as preserving the family from disintegration, reuniting it after dispersal, protecting family housing, providing family units, and taking into account the privacy of some family members. The most important results reached were that the family is a very important entity that must be taken care of in all circumstances, whether war or peace
قاعدة: الإثبات أولى من النفي عند الإمام ابن العربي من خلال كتابه: المسالك في شرح موطأ مالك

ملخص: هذا المقال يدرس قاعدة شهيرة أوردها الإمام ابن العربي في كتابه: المسالك في شرح موطأ مالك. وهي قاعدة:"الإثبات أولى من النفي". وقد جاء المقال في مبحثين. تعرضت في المبحث الأول لتعريف للإمام ابن العربي، ولكتابه المسالك، وتعريف بأصل الاستصحاب وبيان أنواعه. أما في الثاني فقدت قمت بشرح القاعدة، وذكرت بعضا من أدلتها. ثم عرضت نماذج لفروعها من كتاب المسالك، وأنهيت المقال بجملة من الملاحظات والمحددات والضوابط للقاعدة. Abstract : This article examines a famous rule that Imam Ibn Al-Arabi included in his book: Al-Masalak fi SharhMuwatta Malik. It is a rule: "Evidence is first than denial." The article came in two sections. In the first topic, I presented a definition of Imam Ibn al-Arabi, his book Al-Masalak, and a definition of the origin of Al-Issahab and an explanation of its types. In the second, I lost an explanation of the rule, and mentioned some of its evidence. Then she presented examples of its branches from the book of paths, and ended the article with a set of observations, determinants and rules for this rule
مسائل كلامية في صفات المعاني: صفة الكلام الإلهي أنموذجا

الملخص: تعبر الصفات الإلهية من بين أهم المسائل التي طرحت على مائدة البحث في الفكر الإسلامي، حيث لقيت عناية فائقة من الفرق الإسلامية المختلفة، سواء تعلق الأمر بالصفات الخبرية أو صفات المعاني، وإن هذا البحث يعالج أحد أهم أقسام صفات المعاني والمتمثلة في صفة الكلام الإلهي، ويراد بصفات المعاني التي تثبت لذات الله تعالى معنى يليق به، حيث أورد الباحث رأي الجهمية والمعتزلة في كلام الله تعالى، فمعنى كونه عندهم متكلما، أنه خالق للكلام في غيره، وليس الكلام صفة قائمة بذاته، فحقيقة الكلام عندهم هو الحروف المنظومة، والأصوات المقطعة، الدالة على الأغراض الصحيحة. أما الأشاعرة فقد ذهبوا إلى أن الكلام صفة أزلية نفسية، قائمة بذاته تعالى، منزهة عن التقدم والتأخر، منافية لعدم الكلام، مع القدرة عليه. أما ابن تيمية، فقد ذهب إلى أن الكلام من صفات الفعل، موافقا بذلك المعتزلة، كما وافق الأشاعرة في أن الكلام صفة قديمة قائمة بالذات، ويختلف عنهما في اثباته للمشيئة والاختيار. Abstract: The expression of divine attributes is among the most important issues raised on the research table of Islamic thought, since they have received great attention from Islamic groups, whether they are declarative attributes or attributes of meanings, and this research focuses on one of the most important sections of the characteristics of meanings, which is the description of the divine word. And what is meant by the meanings of the attributes that prove the essence of God Almighty is a meaning worthy of him, as the researcher mentioned the opinion of the Jahmiyyah and the Mu'tazila regarding the words of God Almighty, the meaning he has to be a speaker for them, that he is the creator of the word in others than him, and the word is not an attribute in itself, the reality of the word for them, is the organized letters, and sounds and syllables, which indicate the correct purposes. As for the Ash'aris, they argued that speech is an eternal psychological quality, autonomous god almighty, independent of progress and delay. As for Ibn Taymiyyah, he held that speech is an attribute of action, agreeing with the Mu'tazilites, as well as the Ash'aris in that speech is an ancient characteristic existing in itself, and differs from them in its evidence of will and choice
مرتكزات الاستقرار الأسري من خلال القرآن الكريم، سورة البقرة نموذجا

انطلق المقال من إشكالية مفادها: ما هي أبرز مرتكزات ذلكم الاستقرار الأسري من خلال سورة البقرة؟ ويكتسي الموضوع أهمية كبيرة في التعامل مع مشكلات الأسرة في الواقع الراهن، والهدف من هذه الدراسة هو الوقوف على تلك المرتكزات التي بثّها المولى تعالى في آيات سورة البقرة حِكَماً ومقاصد وتعليلات وضوابط، والكشف عن سياق آيات سورة البقرة مما ارتبط بالحياة الأسرية. وقد انتهج المقال المنهج الوصفي لعرض ذلك السياق والمنهج التحليلي لاستخراج تلك المرتكزات والربط بينها، وجاء المقال في محورين بارزين الأول عن سياق آيات البقرة لأحكام المرأة والأسرة، والثاني عن مرتكزات الاستقرار الأسري. ومن أبرز النتائج المتوصل إليها أن الضبط والإحسان، والمعروف والتراضي والتشاور، وإقامة حدود الله، ورعاية كل طرف للطرف الآخر هي أهم المرتكزات في استقرار الأسرة، وأن استحضار المعاني الإيمانية يُوَسِّع أفق الحياة الأسرية مِن ضيق الدنيا إلى سعة الدنيا والآخرة، ومن المتعة إلى قرار العين بأطراف الأسرة. Abstract : The topic of this article is: what are the supports that provide the family constancy, through the surat al- Al-Baqarah ? This subject is very important to dealing with many problems related to the modern family. The aims of this article are precise those supports, and revealed the context of those verses. By employing the descriptive and analytic methods. The article are device into two chapters, the first is for interpreting the verses. The second chapter is for analyzing those meanings. ضَبْطُ الْهَمْزَةِ الْمُسَهَّلَةِ وَحَالَاتُهَا

باب الهمز في علم الضّبط القرآنيّ أطولُ الأبواب وأصعبُها، ومن سُبُل تذليله التّدقيقُ في فرعٍ من فروعه، ومن هذه الفروع ما تقدّمُهُ هذه الدّراسة التي هي "ضَبْطُ الْهَمْزَةِ الْمُسَهَّلَةِ وَحَالَاتُهَا" وتهدِف إلى التّعرّف على ضبط الهمز المسهّل: من حيثُ الهيئةُ واللّونُ والموضعُ؛ وكذلك معرفة جميع حالات ضبط الهمزة المسهّلة: في كلمة، وفي كلمتين؛ عند انفرادها، وعند اجتماعها مع واحدة، وعند اجتماعها مع اثنتَيْنِ. وإنّ من أهمّ النتائج: أنَّ الهمزة المسهّلة في المصحف تُضبَطُ إمّا نقطةً حمراءَ، وإمّا رأْسَ عيْنٍ حمراءَ؛ وأنها إمّا ألّا تكون لها صورة فتُجعل على السّطر، أو تُلحق صورتُهَا بالحمراء: ألفًا أو ياءً، أو واوًا؛ وإمّا أن تكون لها صورة في الرّسم: ألفًا أو ياءً أو واوًا. Abstract: The chapter of Al-Hamz in the Quranic vowelization is the longest and the most difficult. One of the ways to overcome it is to scrutinize one of its branches. Among these branches is what this study provides, which is “Adjust the Light Hamza and its Cases” and aims to identify the vowelization of the light hamza: In terms of shape, color and position; as well as the cases of the vowelization of the light hamza: in one word, and in two words; when alone, when meeting with one, and when meeting with two. One of the most important results: that the light hamza in the Quran is vowelized either with a red dot or the head of a red ‘eyn’; and that it either does not have a writing, so it is placed on the line or its writing is appended to an ‘aliph’, a ‘yaa’ or a ‘waw’ red; either it has a writing in Quran writing: an ‘aliph’, a ‘yaa’, or a ‘waw
أثر التمويل المصرفي الإسلامي على النمو الاقتصادي في ماليزيا، دراسة قياسية خلال الفترة (2000-2021)

تهدف هذه الدراسة إلى أهمية التمويل المصرفي الإسلامي ودوره في تمويل مختلف القطاعات الاقتصادية في ماليزيا، وكذا تحليل أثر التمويل المصرفي الإسلامي على النمو الاقتصادي للبلد للفترة 2000-2021، باستخدام نموذج الانحدار الخطي البسيط، وهذا بالاعتماد على النمو الاقتصادي كمتغير تابع واجمالي التمويل المصرفي الإسلامي كمتغير تفسيري. وخلصت الدراسة إلى أن للتمويل المصرفي الإسلامي له أثر إيجابي ومعنوي على النمو الاقتصادي، وأن للتمويل المصرفي الإسلامي أهمية في تفسير النمو الاقتصادي في الاقتصاد الماليزي. This study aims at the importance of Islamic banking financing and its role in financing various economic sectors in Malaysia, as well as analyzing the impact of Islamic banking financing on the economic growth of the country for the period 2000-2021, using the simple linear regression model, and this is based on economic growth as a dependent variable and total Islamic banking financing as a variable interpretative. The study concluded that Islamic banking finance has a positive and significant impact on economic growth, and that Islamic banking finance is important in explaining economic growth in the Malaysian economy
دلالة نظم أصول التخريج للطحان :دراسة حديثية

ملخص: يتناول هذا المقال طرق تخريج الحديث النبوي الشريف من خلال الأرجوزة التي نظمتها من كتاب الدكتور محمود الطحان ،"أصول التخريج ودراسة الأسانيد " والتي اشتملت على مفهوم التخريج وأنواعه وأهميته وفوائده التي من أجلها يدرس هذا العلم ، وحاول ما أمكن توضيحه لطرق التخريج الخمسة من خلال نظمنا لها ، وتطرق إلى مواضع الطريقة الأولى من خلال معرفة اسم الصحابي الذي رواه بواسطة ثلاثة أنواع : المساند والمعاجم وكتب الأطراف كما بين كون معرفة متن الحديث يكون بواسطة ثلاثة أنواع : الفهارس ، والكتب المصنفة في الأحاديث المشتهرة على الألسنة ،والكتب التي رتبت فيها على ترتيب حروف المعجم ، وأشار إلى الطريقة الثالثة التي تكون لفظة الحديث فيها غريبة ويقل دورانها ويتوصل إليها من خلال مصنف وهو المعجم المفهرس ، والطريقة الربعة في موضوع الحديث واشتملت على المصنفات والسنن والمستخرجات والمستدركات والموطآت ، والترغيب والترهيب ، والفضائل . والطريقة الأخيرة تناول فيها معرفة الحديث بواسطة ثلاثة أنواع من المصنفات ، منها المصنفات المتعلقة بأحوال المتن ، والمتعلقة بأحوال السند فقط ، وثالثتها المتعلقة بأحوال السند والمتن معا. الكلمات المفتاحية: دلالة ؛ نظم ؛ أصول ؛ التخريج ؛ الطحان؛ Abstract This article deals with the methods of graduation of the noble prophetic hadith through the Journal that was organized by Dr. Mahout Al-Tangshan's book, “Fundamentals of graduation and the study of the chain of transmission,” which included the concept of graduation, its types, importance and benefits for which this science is studied. And he tried what was possible to clarify the five methods of graduation through our systems for them, and touched upon the places of the first method by knowing the name of the companion who narrated it in three types: the Mustard, the dictionaries and the books of the parties, as well as the fact that knowledge of the body of the hadith is by three types: indexes, and books classified in the popular hadith on The tongues, and the books in which they are arranged in the order of the letters of the dictionary, He pointed to the third method in which the word hadith is strange and its rotation decreases, and it is reached through a workbook, which is the indexed dictionary, and the fourth method in the subject of hadith, and it included works, Sunbaths, extracts, recapitulations and Maw tat, and enticement and intimidation, and virtues. من أعظم وسائل الدعوة إلى الله الوعظ والخطابة بأنواعها، وقد أولاها الشرع الحكيم والعلماء الأفذاذ عناية بالغة، ومن هؤلاء الإمام ابن الجوزي، فما هي معالم الوعظ والخطابة عند ابن الجوزي، وما ضوابطها، ومصادرها، وما صفات الواعظ والخطيب؟ وتهدف الدراسة إلى بيان المعالم التي سلكها ابن الجوزي في وعظه خطابته ليحصل به الاقتداء، ولتحقيق ذلك سلكت منهجين: المنهج الاستقرائي، والتحليلي. المستخلص تعالج هذه الورقة موضوع ((الدفعة القرآنية الحية واستئناف الدور الحضاري عند مالك بن نبي)) إذا كان دور المسلم ذو جانبين داخلي وخارجي؛ وكان واجبا عليه أن يعرف نفسه وأمته وأن يعرف ما يعتمل في الفكر العالمي، فإن هذا الدور هو في حد ذاته دور "الفكرة الدينية" بجانبيها؛ الجانب الذي يحدد قيمتها الغيبية أي صلتها بعالم الغيب، والجانب الذي يسهم في تكوين وتطوير الواقع الاجتماعي، أي صلتها بعالم الشهادة، وهو نتاج للجانب الأول، ولما كان مالك بن نبي قد تناول كلا الجانبين؛ حيث اتخذ الجانب الخارجي سبيلا في تحليل الظواهر الحضارية المتعددة التي تجلت في أغلب كتبه، وكان بهذه الصفة عالم اجتماع مختص في علم الاجتماع الديني، أما الجانب الداخلي فقد اعتبره نقطة انطلاق الواقعة الحضارية، إلا أنه وجد أن الجانبان يجتمعان معا في النموذج الأمثل والقدوة الحسنة المصطفى  ، ويشكلان "الدفعة القرآنية الحية" من خلال "الظاهرة القرآنية"، لهذا كان هذا الكتاب هو نقطة الانطلاق، إذ يمكن اعتبار مالك بن نبي به عالِم مختص في العقيدة. فالبحث إذن يهدف إلى تفعيل الوعي بالشروط الجديدة –"شروط النهظة"- لعودة الظاهرة القرآنية وتحقيق الإعجاز. كما يهدف إلى دفع الإنسان عن طريق القرآن الكريم –"الدفعة القرآنية الحية"- إلى اليقظة والتدرج في مراتب الإسلام حتى يصل إلى مرتبة الإحسان، مرتبة الرجل الأمة صاحب الخلق العظيم الذي يؤدي إلى ميلاد مجتمع يستأنف الدور الحضاري ويحرك التاريخ. Abstract This paper deals with the issue of (the Quranic live batch and the resumption of the cultural role of Malik bin Nabi). If the role of the Muslim has two sides internal and external and that it was his duty to know himself and to know what is happening in the world, it is this role in itself that carries the role of the "religious idea" on its side; the side that determines its unseen value, ie its relation to the world of the unseen, and the side that contributes to the formation and development of social reality, that is its relation to the world of testimony which is a consequence of the first side. Since Malik bin Nabi has dealt with both sides; taking the external side as a way in analyzing the various cultural phenomena that have been reflected in most of his books, and with this characteristic became known as a sociologist specialized in religious sociology. He took the internal aspect as the starting point of the civilizational event, but found that the two sides meet together in the ideal model and the good example Mustafa  and constitute the "Koranic live batch" in the "Quranic phenomenon", so this book is the starting point, since Malik bin Nabi can be considered a scientist specialized in faith. Therefore, the research aims at activating awareness of the new conditions - "conditions of awakening" - for the return of the Qur'anic phenomenon and the achievement of miracles. It also aims at pushing the human forward through the Quran - the "Quranic Life Batch" - to the vigilance and gradualization of the ranks of Islam until it reaches the rank of charity, the ranking of the nation's man, the one with the great manners which lead to the birth of a society that resumes the role of civilization and moves history

ملخص: إن الاهتمام بدراسة الأديان, له فوائد, ومن أبرزها أن يتبين ما عليه سائر الأديان من انحرافٍ , مقارنةً بما تميز به الإسلام, فيزيده هذا يقيناً بدينه. ولاشك أن هناك عوامل أدّت لانحراف النصرانية, يُستحسن تسليط الضوء عليها؛ مما يعزز القدرة على التعامل العلمي مع الأديان غير الإسلام, ومعرفة واقعها البعيد عن الوحي, وهذا في حقيقته عامل يسهل دعوة أصحاب الأديان, بإبراز مواضع الانحراف والفساد في دياناتهم، ثم إظهار نصاعة الإسلام وسلامته من التحريف, وذلك وفق منهجٍ علمي قائم على الوصف والتحليل. فتظهر هذه الدراسة أن النصرانية, تكونت أركانها بعد مرورها بمراحل؛ مروراً بالانحرافات؛من ضياع الكتاب المقدس, فعصر الاضطهادات, والتأثر بالوثنيات والفلسفات, ثم المجامع التي قررت العقائد والشرائع. كما توضح أن لبولس دورٌ في انحرافها؛ حيث قرر الكثير من العقائد المخالفة لرسالة المسيح عليه السلام. فنستخلص من هذا أن الديانة النصرانية, المنزلة من عند الله في أصلها, ديانة توحيدية, وليست ديانة تعدد وتثليث, شأنها في ذلك شأن سائر الأديان السماوية الأخرى. :Abstract There is no doubt that there are factors that led to the deviation of Christianity, and it is advisable to highlight them; Which enhances the ability to scientifically deal with religions other than Islam, and to know their reality far from revelation, and this is in fact a factor that facilitates inviting the followers of religions, by highlighting the sites of deviation and corruption in their religions, and then showing the purity of Islam and its safety from distortion, according to a scientific approach based. This study shows that Christianity formed its pillars after passing through stages. It also shows that Paul had a role in her deviation; Where he decided many beliefs contrary to the message of Christ. We conclude from this that the Christian religion, which was revealed from God in its origin, is a monotheistic religion, not a religion of plurality and trinity, like all other monotheistic religions

ملخص: هذا البحث تحقيق مخطوط للعلاّمة ابن المزجَّد (930ه) الشافعي, في الأخلاق والآداب, مع الخالق ومع المخلوق؛ حيث تنوّعت أبياته بين الترغيب في الأخلاق الحميدة, والترهيب من الأخلاق المذمومة. وقد قسّمت البحث إلى ثلاثة مطالب, خصّصت المطلب الأول للتعريف بالناظم؛ شهاب الدّين ابن المزجَّد, فذكرت حياته الشخصيّة, والعلميّة, وتناولت في المطلب الثاني للتّعريف بالنّظم؛ مبيّنا نسبة المخطوط وتسميته, ثم موضوعه, وبعدها وصف شامل للمخطوط, والعمل الذي قمت به في تحقيقه, وفي المطلب الثالث تحقيق نصّ المخطوط. Abstract : This research is a written investigation of the scholar Ibn al-Mozjjad (930 Hijri) Al-Shafi’i, in morals and manners, with the Creator and the creature; Where his verses varied between calling out for good manners, and intimidation of the unwanted morals. This research is devided into three sections, allocating the first requirement to introduce the organizer; Shihab al-Din Ibn al-Mozajjad, where I mentioned his personal and scientific life, in the second part, I have dealt with the introduction of the his scientific system ; Indicating the proportion of the manuscript and its name, then its subject, and then a comprehensive description of the manuscript, and the work that I did in its realization, and in the third part the achievement of the written manuscript

ملخص: شهد الاهتمام بقيمة الحريّة تطورا كبيرا في العصر الحديث عاكسا المنزلة التي أصبح يحتلها الفرد في التمتع بحقه داخل الدولة والمجتمع، ما أتاح لبعض الفئات المجتمعية كفئة الشواذّ في المجتمع الغربي المطالبة بحقّها في التمتع بحرية التعبير عن أفكارها وممارسة قناعاتها،إلا أن هناك قيودا ومعايير مختلفة في النظر لقيمة الحريّة تختلف من بلد لآخر، ومن منظومة فكريّة لأخرى، فهناك من يدعو إلى إطلاقها بدون قيود، وهناك من يدعو إلى التعقّل في تمثلها وإلى الانضباط بالآداب والقيم الدّينية لتثمر حقا تلك المفاهيم النبيلة المرتبطة بها. إن الاختلاف في النظر لقيمة الحرية يرجع إلى اختلاف المقومات الفكرية والرصيد التاريخي الثقافي والمعرفي لكل حضارة ولكل دين، لذلك عندما يريد المرء دراسة الحرية في مجتمع ما يجب عليه لتطرّق للخلفيّة التي شكّلتها ليتمكن من تحليلها ونقدها. وقد جاءت هذه الدراسة لتلقي الضوء على قيمة الحرية في حادثة رفض المسلم السنغالي إدريسا غاي–لاعب كرة القدم- ارتداء قميص يحمل ألوان علم الشذوذ الجنسي، وقد توصلت إلى أن الحريات العامة التي ينادي بها الغرب لم تكن في يوم من الأيام هدفا بحد ذاتها، بل عرضا لتنامي إرادة القوة في أوربا، والقبول بالحوار يعتمد على تحقيق المصالح الخاصّة بهم. كما أن للشذوذ الجنسي فلسفة تاريخيّة عند من يدعون إليه، فهو ليس مجرّد تحدّ للمجتمع الحديث وأخلاقه التقليدية. abstact: Interest in the value of freedom has seen a great development in modern times. This has enabled certain social groups, such as homosexuals in Western society, to claim their right to freedom of expression and the freedom to practice their beliefs. However, there are different restrictions and criteria for assessing the value freedom which differ from one country to another, and from one intellectual system to another. The difference in the consideration of the value of freedom is due to the different intellectual components and the historical, cultural and cognitive stock of each civilization and each religion. Thus, when we want to study freedom in a society, we must look at the context that has formed. so that we can then analyze and criticize it. For this reason, this study has come to illuminate the value of freedom in the incident of the Senegalese Muslim Idrissa Guy - the football player - refusing to wear a shirt with the colors of the flag of homosexuality ,and it has concluded that the civil liberties that the West demands today have never been an end in themselves, but rather a symptom of the growth of the will to power in Europe, and that the acceptance of dialogue depends for the pursuit of their own interests. As well as homosexuality has a historical philosophy for those who defend it, because it is not only a challenge to modern society and its traditional morality

ملخص: يُعتبر التَّأمين التَّكافلي الصِّيغة الشَّرعيَّة البديلة لصيغ التَّأمين التجارية التقليديَّة والكلاسيكيَّة، وهو من الصِّيغ التَّأمينيَّة التي لقيت رواجا وانتشارا واسعا في مختلف البلدان الإسلاميَّة، وقد تمَّ اعتماد هذه الصِّيغة رسميا من قبل المشرِّع الجزائري ونشر ذلك في الجريدة الرَّسميَّة، وقد جاء هذا البحث بهدف تسليط الضَّوء على هذه الصِّيغة التَّأمينيَّة التعاونيَّة، ومدى تأثيرها على التَّمويل الإسلامي وتحقيق التَّنمية المحليَّة. حيث بيَّنت هذه الدِّراسة مفهوم التّأمين التَّكافلي، وكذا المبادئ والخصائص التي تقوم عليها هذه الصِّيغة، كما حرص البحث على بيان الحكم الشَّرعي لهذا التَّأمين وذكر أبرز المجامع الفقهيَّة والهيئات الشَّرعيَّة التي أفتت بجوازه، وقد خلص البحث إلى إظهار البعد التَّنموي والاستثماري للتَّأمين التَّكافلي، ومدى تأثيره في تطوير التَّمويل الإسلامي، وتحقيق التَّنمية في قطاع الفلاحة على وجه الخصوص. ملخص : يقتضي الواجب تسليط الضوء على خصوصية التجربة التونسية النّموذجية في تحقيق النهضة الثقافية والفكريّة والإصلاحية، وإثراء الذاكرة الجماعية الوطنية التونسية، وتكريم جيل الروّاد من صانعي ربيع الاستقلال الوطني، ومن بينهم الشيخ سالم بن حميدة الأكّودي من منطقة الساحل التونسي من مدينة أكودة بولاية سوسة التي ينتمي إليها، وهذا فيه إشارة واضحة لإبراز دور المدن والقرى والبلدات التونسية كل من موقعها وضمن خصوصياتها في الحركة الإصلاحيّة الوطنية. جمع الشيخ بن حميدة بين سمات الفيلسوف المتصوّف المُقبل على الحياة والدّاعي إلى إعمال العقل والتّجديد، إضافة الى نشاطه الوطني في النّضال من أجل تحرير المجتمع من التخلّف والوطن من الاستعمار، فضلا عن دوره في الحثّ على الحريّة والعدالة والتسامح والحوار بين الحضارات والشّعوب، تتلمذ على يديه الطاهر الحداد صاحب كتاب "امرأتنا في الشريعة والمجتمع"، وعبد الرزاق كرباكة صاحب جريدة الزمان الفكرية والأدبية وغيرهم... كما ترك الشيخ سالم بن حميدة آثارا أدبيّة وفكريّة تمثّلت في: "ديوان الزهريّات"، متكوّن من مقالات نثريّة وقصائد شعريّة تحوصل مجمل أفكاره الإصلاحية، كما كتب في الصحف التونسيّة الصّادرة في عصره، وهو علم من أعلام الزيتونة .
