Item La Mise En œuvre Des Principes De La Commande Publique Dans La Nouvelle Règlementation Algérienne De La Délégation Service Public(University of Eloued جامعة الوادي, 2022-04-28) Ahmane, KheiraLa nouvelle règlementation algérienne régissant la convention de délégation de service public a soumis l’attribution de cette dernière aux principes universels de la commande publique. Il s’agit du principe d’égalité de traitement des candidats, la transparence des procédures de sélection et la liberté d’accès. Cela dans des contrats conclus traditionnellement selon l’intuitu personae. Ainsi, Nous allons élucider les mécanismes de mise en œuvre des principes de la commande publique, à la lumière du droit algérien et plus spécifiquement, le décret exécutif 18-199 relatif à la délégation de service public, tout en conciliant avec l’intuitu personae comme critère de sélection. Abstract: The new Algerian regulations governing the public service delegation agreement made the attribution of the latter subject to the universal principles of public procurement. This concerns the principle of equal treatment of candidates, the transparency of selection procedures and freedom of access. This is in contracts traditionally concluded according to the intuitu personae. Thus, we will elucidate the mechanisms for implementing the principles of public procurement, in the light of Algerian law and more specifically, executive decree 18-199 relating to the delegation of public service, while reconciling with the intuitu personae as a selection criterion.
