| dc.description.abstract | إن الحديث عن الإدارة العامة بشكل عام يستلزم مباشرة التحدث عن الموظف العام، لترابط الإدارة العامة بالعنصر البشري ألا وهو الموظف، الذي يعد عنصراً فعالاً في صيرورة المرفق العمومي، الأمر الذي جعل المشرع الجزائري يولي اهتماما كبيرا به، وعمد إلى تقننين وتنظيم حقوقه وواجباته من خلال أحكام الأمر (06/03) المؤرخ في 15 جويلية 2006 المتضمن القانون الأساسي العام للوظيفة العمومية. حيث تضمن هذا الأمر الحقوق والواجبات وتنظيم المسار المهني للموظف، وبعدها صدر المرسوم التنفيذي (20/373) المؤرخ في 12 ديسمبر 2020 المتعلق بالوضعيات القانونية الأساسية للموظف مثل وضعية القيام بالخدمة –والوضع تحت التصرف والانتداب والخدمة الوطنية والاستيداع ، حيث حدد هذا المرسوم كل الشروط والإجراءات التنظيمية لهذه الوضعيات القانونية الأساسية للموظف العام، وعمد إلى شرحها وتفسيرها.Talking about public administration in general directly entails talking about the public servant of the interrelation of public administration with the human element, namely the employee, who is an effective element in the process of the public facility, which made the Algerian legislator pay great attention to it, and deliberately codified and organized his rights and duties, the matter came No. 06-03 of July 15, 2006 containing the General Basic Law for the Public Service.
