Item تطبيق مبدأ استمرارية المرفق العام في ظل المخاطر الصحية(2023) ضو, سعد; محمد الفاضل حشاشن, محمد الفاضلإن مبدأ استمرارية سير المرفق العام من الركائز الهامة التي تقوم عليها المرافق العامة في أي دولة، فلا يمكنه تصور توقف المرفق العام عن تقديم الخدمات المرفقية للمنتفعين منه، إلا أنه هناك حالات تستدعي تعطيل هذا المبدأ وتوقف المرفق عن تقديم خدماته ومنها حالات المخاطر الصحية التي تهدد حياة الأفراد والمجتمع. ونظرا للأهمية البالغة التي يحتلها المرفق العام في حياة المجتمع عامة، وفي حياة المرتفقين منه خاصة، اتخذت الحكومات والتشريعات جملة من الإجراءات التي من شأنها ضمان استمرارية المرفق العام في تقديم خدماته للجمهور، وتتمثل هذه الإجراءات في ضمانات تشريعية كتنظيم حق الاستقالة وتقييد حق الإضراب، ومنها ما هو قضائية كنظرية الموظف الفعلي ونظرية الظروف الطارئة التي استنبطها القضاء الإداري الفرنسي، بالإضافة إلى اعتماد الإدارة الإلكترونية كضمان جديد استحدثته الظروف الوبائية والصحية التي عرفها العالم في الفترة الأخيرة The principle of the continuity and continuity of the operation of the public facility is one of the important pillars of public utilities in any State.
