أحكام نفاذ رهن الدَّيْن العادي اتجاه الغير في القانون المدني الجزائري

Abstract

يقع الرّهن على الدَّيْن باعتباره منقولا في القانون المدني الجزائري، وهو يخضع في تنظيمه إلى الأحكام العامة للرهن الحيازي من جهة، وإلى أحكام أخرى خاصة ترجع لطبيعة الدَّيْن وموضوعه من جهة أخرى، وسنقتصر البحث في هذا المقال على الأحكام المتعلقة بمسألة نفاذ رهن الدينَّ العادي في حق الغير في القانون المدني الجزائري، لكونه قد يحدث أنْ يكون لشخص على آخر ديْنٌ، ويَقُوم برهنه لدائنه، ثُم يدعي شخص آخر أن له حقا مكتسبا على الدَّيْن المرهون، ومن هنا وحِفَاظًا على مراتب أصحاب الحقوق في اقتضاء حقهم من الدَّيْن المَرهُون، كان لزاما تنظيم مسألة نفاذ رهن الدَّيْن في حق الغير، وهذا ما فعله المشرع الجزائري في القانون المدني.
