Abstract

This article deals with a study concerning competence of the administrative judge relating to the disputes of the economic censorship authorities. Given that the legislator gave opportunity to people addressing its decisions the right to introduce before the State Council, under laws, recourse, considering that competences of the State Council are determined under membership regulations. We may also find that the different texts regulating competences of the State Council do not refer to its competence as to these disputes, what may lead to doubt about the constitutionality of these constituent texts, and accordingly, to the constitutionality of the judicial control. The absence of clear standard of the distribution of the competences between the State Council and the ordinary justice, as to the decisions of the competition council, indicates to an obvious violation of the competence of the State Council, given the membership standard.
