Abstract

تهدف ألية الدفع بعدم الدستورية في الأساس إلى حماية حقوق وحريات الأفراد ،إلا أن دورها في واقع الأمر لا يقتصر على ذلك فحسب، وذلك لإعتبارها وسيلة تسهم في تنقيح المنظومة القانونية من النصوص التشريعية المتناقضة مع أحكام الدستور من خلال كشفها عن حالات عدم الكفاءة السلبية التي تثبت إخفاق الهيئة التشريعية في ممارسة إختصاصها التشريعي، إلا أن دورها محدود بنظر لما تخضع له هذه الألية من قيود تشريعية ومايحيط بها من عراقيل تحد من إمكانية إثارتها و إستمراريتها لتحكم قضاة القانون في تحديد مصير الدفع ناهيك على مايترتب عن سيطرة القاضي الدستوري على الأحكام التشريعية التي تناولها الدفع. The unconstitutional defense mechanism aims mainly to protect the rights and freedoms of individuals, but in reality its role is not limited to that only because it is considered a means that contributes to revising the legal system of legislative texts that contradict the provisions of the constitution by revealing cases of negative incompetence that prove the failure of the commission However, its role is limited by the legislative restrictions that this mechanism is subject to and the obstacles surrounding it that limit the possibility of raising it and its continuity. Law judges rule in determining the fate of the payment, not to mention the consequences of the constitutional judge’s control of the legislative provisions dealt with in the defense.
