| dc.description.abstract | نتناول في هذا المقال مسألة خلق التوازن بين تجريم الإجهاض من طرف الطبيب لأجل إعطاء فرصة الحياة للجنين، وبين إباحته بهدف المحافظة على الأم، وذلك من خلال التطرق إلى الحالات التي يعتبر فيها الطبيب مرتكبا لجريمة الإجهاض بواسطة الوصفة الطبية، وكذا الحالات التي يباح له إجهاض الحمل بنفس الأداة، بدون أن يعتبر هذا الفعل جريمة، وذلك بدراسة أركان هاته الجريمة وعقوبتها وأسباب الإباحة المتعلقة بها. In this article, we address the issue of creating a balance between the criminalization of abortion by the doctor in order to give the fetus a life opportunity, and his legalization with a view to preserving the mother, by addressing the cases in which the doctor is considered a perpetrator of the crime of abortion by prescription, as well as cases that allow him to abort pregnancy With the same tool, without this act being considered a crime, by studying the pillars of this crime, its punishment and the reasons for its legalization. | en_US |
