الحكم التشريعي في دعوى الدفع بعدم الدستورية " دراسة مقارنة بين فرنسا والدول المغاربية "

Abstract

يهدف هذا المقال الى البحث في مدلول الحكم التشريعي المعني بدعوى الدفع بعدم الدستورية،وهذا انطلاقا من الأحكام الفقهية والدستورية والتشريعية،التي تبناه كل من المؤسس الدستوري الفرنسي والمؤسس الدستوري المغاربي (الجزائر،المغرب،تونس)،وصولا الى موقف القضاء الدستوري العملي،وذلك من خلال تحديد النصوص القانونية التي يتم احالتها عن طريق الدفع بعدم الدستورية من الجهات القضائية العليا،الى المحاكم والمجالس الدستورية،وقبول معالجتها والفصل فيها.This article investigates the meaning of the legislative ruling on the claim of unconstitutionality, and this is based on the jurisprudential, constitutional and legislative provisions adopted by both the French constitutional founder and the Maghreb constitutional founder (Algeria, Morocco, and Tunisia), as well as to the practical position of the constitutional judiciary, by specifying the legal texts that are transmitted by means of a petition of unconstitutionality from the higher judicial authorities to the courts and the constitutional councils, and then accepting its treatment and adjudication.
