التمويل الإسلامي من خلال بيع المرابحة للآمر بالشراء مصرف السلام الجزائري انموذجا

Abstract

"تناول هذا البحث موضوعا يكتسي أهمية بالغة في الفقه الإسلامي المعاصر، وهو صيغة من صيغ التمويل الإسلامي المستحدثة وهي بيع المرابحة للأمر بالشراء، وقد أجابت الدراسة على عدة إشكالات، أهمها ما حقيقه بيع المرابحة للأمر بالشراء، وما مدى التزام مصرف السلام بالضوابط والشروط الشرعية في تطبيق بيع المرابحة للأمر بالشراء؟ وما مفهوم التمويل الإسلامي؟ وقد كانت الإجابة ضمن ثلاثة مباحث: فأما الأول: فتضمن ماهية التمويل في الاقتصاد الإسلامي، وأما الثاني:عرف بيع المرابحة للأمر بالشراء، وذكر صور تطبيقية في المصارف والشروط اللازمة لسلامة هذا البيع,كما تضمن أراء الفقهاء فيه:أما الثالث: فاحتوى على الجانب التطبيقي لهذا البيع بمصرف الإسلام."The present paper has tackled an important issue regarding contemporary Islamic jurisprudence. This research attempts to find solution and answers on Murabaha sale for a purchase order which is a formula of modern Islamic finan cing. Research questions were mainly as follows: what did Murabaha sale for purchase order achiene so far? To what exten does Isslam bank comply with the rules and regulation in applying Murabaha sale for purchase order? What is Islamic funding? The research has come to find out answers to the research questions. Answers are explained in three chapters. In the first one, we have clarified the utility of funding in Islamic economics. In the second chapter, we have defined Murabaha sale for a purchase order and have portrayed some practices in banks and listed the required conditios to make the sale safe, moreover, we have included the jwrists views on this kind of sole. The third chapter includes the pratical side of this sort of sale in Esslam Bank. And we come to these main results. .
