Abstract

من الأدلة التي اختمف فييا العمماء قديما وحديثا ، قول الصحابي . وقد حاولنا في بحثنا ىذا تحقيق ىذه المسألة ود ا رستيا د ا رسة أصولية مقارنو ، مع بيان أثر الاختلاف فييا في الاختلاف في الأحكام الفقيية ، وفي الأخير توصمنا إلى أن قول الصحابي حجة وأن لو آثا ا ر كبيرة عمى الفروع الفقيية . Abstract The prophet's companion speech is one of controversial arguments , it has a great importance in legal judgments field, in this modest work, we try to study this problem with comparative method, and we essay to clarifyits influences in juristic opinions in the end we conclude that the prophet's companion doctrine considers like one of the approved legal arguments, and the scholars mentioned many influences for prophet's friend speech in juristic opinion
