Abstract

"ملخص: يعالج هذا البحث دراسة حول ""أثر القياس في النوازل المالية المعاصرة""، حيث قسمت هذا البحث إلى مقدمة ومبحثين وخاتمة. فاحتوى المبحث الأول على البيان التأصيلي للقياس نظرياً، فتضمن هذا المبحث تعريف القياس، وأدلة حجيته، وذكر أركانه وشروطه، وبيان أقسامه، كما تضمن أيضا بيان أهمية القياس، والحاجة إليه في استنباط الأحكام على النوازل المعاصرة. أما المبحث الثاني فتطرقت فيه إلى دارسة تطبيقية للقياس على النوازل المالية المعاصرة، وانْتَقَيتُ هذه النوازل من أبواب المعاملات المتعددة، لتتنوع على ثلاث مطالب ( البيع بالوسائل الاتصال الحديثة، والتأمين التجاري، التسويق الشبكي). وقدتمّفيهذاالبحث _ بحمدالله _ دراسةغالبالأقيسةالتياستدلبهاالعلماء والباحثونالمعاصرون فيالنوازلالمالية المعاصرة المذكورة آنفا،وتمييز الأصلوالفرعوالوصفالجامع فيها، وبيان ما تقتضيه من أحكام. " "Abstact: This researchtreats a study about ''the reasoning's impact on the contemporaryfinancial issues, so I divideditinto an introduction, twochapters and a conclusion. The first chapterincludes, theoretically, an establishedstatementwhichcontains the reasoning'sdefinition, authority, basis,condition, and types alsoits importance in the deductionofthejudgments on the contemporary issues. For the second chapter, I took up appliedstudy on the contemporaryfinancial issues, selectedthemfromdifferent transactions thatdiversifiedintothreethemes (the sellingthrough the modern media, the commercial insurance and the website marketing). In the praise of God, I have studied the almostreasoning's types which the scholars and the contemporaryresearchesinfer on financial issues mentionedjustnow, distinguishing the foundation, the subsidiary and the inclusive description by illustratingwhat the judgmentsinquire.
