المسؤولية الجنائية عن الجرائم المرتكبة تحت تأثير المخدرات والمؤثرات العقلية - دراسة مقارنة بين الفقه الإسلامي والقانون الجزائري

Abstract

ملخص: لقد باتت ظاهرة المخدرات الوباء الذي يأبى الانقضاء، ومحاولة الدول سن قوانين صارمة لردعه، خصوصا بعدما ارتبطت المخدرات بالجريمة، سواء من أفراد أو جماعات وأضحى العالم بأسره في خطر داهم منها. إن دراستنا هذه تختص بالمسؤولية الجنائية للفرد عند ارتكابه للجريمة وهو تحت تأثير المخدرات والمؤثرات العقلية، مبرزين موقف الفقه الإسلامي والقانون الجزائري اتجاه هذه المسؤولية، لذا طرحنا الإشكالية الآتية: "ما هو موقف الشريعة الإسلامية والمشرّع الجزائري من المسؤولية الجنائية للجرائم التي ترتكب تحت تأثير المخدرات والمؤثرات العقلية؟ وللإجابة على الإشكالية المطروحة، تم التطرق إلى مفهوم المسؤولية الجنائية وبيان موانعها وأسباب الإباحة منها، كما تم ذكر موقف الفقه الإسلامي والقانون الجزائري من تناول المخدرات والمؤثرات العقلية والإدمان عليها وكذا الاتجار بها، مع بيان للعقوبة المقررة لهم. كما تمت الإشارة إلى علاقة المخدرات بالجريمة والآفات الاجتماعية الأخرى، ثم ختمت الدراسة ببيان موقف الشريعة الإسلامية والقانون الجزائري من قيام المسؤولية الجنائية للجرائم المرتكبة تحت تأثير المخدرات والمؤثرات العقلية. ومن أهم النتائج المتوصل إليها، أن المسؤولية الجنائية للجرائم المرتكبة تحت تأثير المخدرات قائمة إلا في الحالات التي تدل على غير ذلك.

Summary: The drug phenomenon has become an epidemic that refuses to end, and countries are trying to enact strict laws to deter it, especially after drugs have been linked to crime, whether by individuals or groups, and the whole world has become in imminent danger from it. Our study is concerned with the criminal responsibility of the individual when he commits a crime while he is under the influence of drugs and psychotropic substances, highlighting the position of Islamic jurisprudence and Algerian law towards this responsibility, so we raised the following problem: mental? In order to answer the problem at hand, the concept of criminal responsibility was discussed, its prohibitions and the reasons for its permissibility, and the position of Islamic jurisprudence and Algerian law regarding drug use and addiction to psychotropic substances, as well as trafficking in them, with a statement of the punishment prescribed for them. The relationship of drugs with crime and other social evils was also mentioned, then the study concluded with a statement of the position of Islamic Sharia and Algerian law on establishing criminal responsibility for crimes committed under the influence of drugs and psychotropic substances. Among the most important findings, is that criminal responsibility for crimes committed under the influence of drugs exists, except in cases that indicate otherwise.
