حماية مواقع ومناطق التوسع السياحي افي الجزائر

Abstract

إن تمركز النشاطات الاقتصادية في المناطق الساحلية،جعلها محل مصالح متضاربة ومتعارضة،لهذا حاول المشرع بناء نظام قانوني متكامل عبر قوانين تهيئة الإقليم و العمران، و حماية الساحل،وقانون التراث الثقافي ومختلف المخططات التهيئة السياحية، لإحداث التوازن بين ترقية الاستثمار في هذه المناطق وحمايتها في آن واحد. غير أن تكريس مبدأ التوازن بالجزائر مازال بعيدا ، فمن جهة لا يوجد تثمين وحماية مواقع التوسع السياحي الساحلية بل وجد تدهور واستنزاف لهذه المناطق بفضل التعمير المفرط وغير المدروس بالبنايات ،وبمشاريع لا تمت صلة بالاستثمار السياحي،لاسيما استنزاف الأوعية العقارية المخصصة للاستثمار، مما أدى بعزوف الكثير من المستثمرين لتوطين مشاريعهم الاستثمارية في المناطق القابلة للبناء. Economic activities are centered in the sites and areas of tourism expansion in the coastal areas .These areas are subject to greed and conflicting interests. That’s why the legislator tried to find mechanisms and legal protective system through laws of preparation of territory urbanization , coastal protection and cultural heritage law and various touristic preparation schemes to make a balance between investment promotion in these areas and protect them at the same time with reconciling conflicting requirements because the logic of excessive protection will sterilize this region so, logic dictates that we must protect the natural and cultural situation of the coast and ensure at the same time economic valuation of tourism investment.. However, the consecration of the principle of balance often fails in Algeria because on one hand there is no valuation and protection of tourist expansion sites but deterioration and depletion of these areas due to excessive and unplanned reconstruction and buildings and projects not related to tourism investment especially the depletion of real estate investment which led to the reluctance of many investors to settle their investment projects in construction areas and this did not help them in this unclear investment policy although these areas have unique natural and cultural components that can be hired to bring in tourism and upgrade tourism investment
