أحكام ممارسة الشعائر الدينية لغير المسلمين في الفقه الإسلامي والقانون الجزائري

Abstract

ملخص: تتطرق هذه الورقة البحثية لموقف الشريعة الإسلامية والقانون الجزائري من حرية المعتقد لغير المسلمين, حيث انطلق البحث بتعريف "غير المسلمين" في الفقه الإسلامي والقانون الجزائري وتحديد الفئة المعنية بهذه الحرية, ليبحث بعدها في أقوال فقهاء الإسلام والقوانين التي وضعها المشرع الجزائري حول مسألة منحهم الحق في بناء أو تخصيص أماكن للعبادة, وممارسة وإظهار الشعائر والطقوس الدينية, وكيف ضبط التشريع الإسلامي والقانون الجزائري الحرية الدينية لغير المسلمين, وأهم القيود التي وُضعت لها, وذلك حماية للأمن والنظام العام للمجتمع المسلم. وخلُص البحث إلى جملة من النتائج والتوصيات, حول تنظيم المشرع الجزائري لحرية ممارسة الشعائر الدينية لغير المسلمين. Abstract: This research paper examines the position of the Islamic Shariaa and the Algerian law on the freedom of belief for non-Muslims. The research started by defining "non-Muslims" in Islamic jurisprudence (Fiqh) and Algerian law, and determining the category concerned with this freedom. Then, it investigates the statements of the Islamic jurists and laws set in place by the Algerian legislator on the question of granting them the right to build places of worship, and to practice and demonstrate the religious rates and rituals. It also deals with how the Islamic jurisprudence and the Algerian law fixed the question of the religious freedom of non-Muslims and the most important restrictions which they were led down on them in order to protect the security and public order of the Muslim community. The study concluded with a number of conclusions and recommendations concerning the issue of regulating freedom of the practice of religions for non-Muslims by the Algerian legislator.
