إجراء توقيف الطفل الجانح للنظر وفق التشريع الجزائري

Abstract

من خلال قانون حماية الطفل أكد المشرع الجزائري على منح ضمانات أكبر للحرية الشخصية للطفل الجانح أثناء توقيفه للنظر من تلك المقررة للبالغين في قانون الإجراءات الجزائية، ليثبت مدى اهتمامه لهذه الفئة ومدى مراعاته لظروف سنهم وحالتهم النفسية، وليثبت مدى احترام الدولة الجزائرية لحقوق الإنسان وحرياته الأساسية. Abstract: Through the Child Protection Act, the Algerian legislator affirmed that greater guarantees of the personal liberty of the delinquent child during his detention should be granted to those adults in the Code of Criminal Procedure to prove his interest in this group and the extent to which he respects the circumstances of their age and psychological condition, and to demonstrate the extent to which the Algerian State respects human rights and fundamental freedoms.
