مكافحة الفساد المالي على ضوء القواعد الفقهية

Abstract

"يهدف البحث إلى بيان دور القواعد الفقهية وما لتطبيقاتها من فعالية في مكافحة الفساد المالي ووضع حد لانتشاره، من خلال تسليط الضوء على وضع مفهوم للفساد المالي الذي تنوع وتعدد وصفه تبعاً للتغيرات التي تحدث في العالم، ومن دون الإلمام الجيد بصوره وأشكاله لا يمكن وصف العلاج المناسب له، فمن هنا قمنا بتوضيح صوره ومظاهره التي هي أكثر انتشاراً وتهديداً ومن أهمها: الرشوة، والاختلاس، وتبديد المال العام، وتبييض الأموال، والتهرب الضريبي، والتعاملات المحرمة وغيرها، وكذلك تحليل لآثاره وانعكاساته السلبية والمدمرة التي خلفها. توصلنا إلى وجود قواعد متعلقة بمكافحة الفساد المالي مبنية على قيم وأخلاق ومبادئ جاء بها ديننا الحنيف، تمثلت في ثناياها على تعليمات وتوجيهات تضبط النفس وتبين لها الحلال من الحرام، وتحذير من ظلم الناس وأكل أموالهم بغير حق، والابتعاد عن الكسب الحرام، وتحريم التعدي على الأموال العامة." The research aims to elucidate the rile of jurisprudential principles and their effective applications in combating financial corruption and curbing its spread by highlighting a comprehensive definition of financial corruption, which has been described in various ways due to global changes. without a thorough understanding of its forms and manifestations, we clarified its most prevalent and threatening forms and manifestations, including bribery, embezzlement, misappropriation of public funds, money laundering, tax evasion, prohibited transactions, and others, as well as analyzing its negative and destructive effects and epercussions. We concluded that there are principles related of combating financial corruption based on the values, ethics, and principles brought by our noble religion. These principles include instructions and guidelines that control the self, distinguish between the permissible and the forbidden, warn against injustice and unlawfully taking people's money, encourage avoiding illicit gains, and prohibit encroaching on public funds. "
