"ملخص البحث

يتناول هذا البحث موضوع ""مسقطات الحقوق المالية للزوجة والأولاد في الفقه الإسلامي والقانون الجزائري (دراسة مقارنة)"" ، وذلك بتتبع ألفاظه ومعانيه وسياقته، فما هي الحالات التي تسقط فيها الحقوق المالية للزوجة والأبناء؟ وحتى نجيب على هذا السؤال قسمنا الدراسة إلى ثلاث مباحث: المبحث التمهيدي تناولنا فيه مفاهيم حول الموضوع, ثم في المبحث الأول تطرقنا فيه إلى الحقوق المالية للزوجة والأولاد من الناحية الشرعية ومن الناحية القانونية، أما في المبحث الثاني فتطرقنا إلى مسقطات هذه الحقوق, حيث أن الشارع الحكيم والمشرع الجزائري منح للزوجة والأولاد حقوقا مالية واسعة ترتبت على عاتق رب الأسرة ومن ناحية أخرى فإن المشرعين أسقطا هذه الحقوق في حالات معينة. وخلصت الدراسة إلى أن هناك حقوق مالية للزوجة والأولاد وجب إسقاطها في حالات معينة. This research deals with the topic of “The Impact of Financial Rights of the Wife and Children in Islamic Jurisprudence and Algerian Law (Comparative Study)”, by tracing its vocabulary, meanings and context, so what are the cases in which the financial rights of the wife and children are waived? In order to answer this question, we divided the study into three topics: The introductory topic covered concepts on the topic, then in the first topic we dealt with the financial rights of the wife and children from the legal and legal point of view. Al-Hakim and the Algerian legislator granted the wife and children extensive financial rights that were entrusted to the head of the family, and on the other hand, the legislators waived these rights in certain cases. The study concluded that there are financial rights for the wife and children that must be waived in certain cases.
