آليات حماية حقوق الزوجة المالية -دراسة مقارنة بين الفقه الاسلامي و القانون الجزائري

Abstract

"تناولت في هذه الدراسة آليات حماية حقوق الزوجة المالية في الشريعة الإسلامية والقانون الجزائري، وذلك من خلال دراسة الحقوق المالية للزوجة وآليات حمايتها قانونيا والنظام المالي الذي يمكن اعتماده كآلية قانونية لحماية حق الزوجة المالي أثناء الرابطة الزوجية، وأثناء انحلال الرابطة الزوجية. وتكون هاته الحماية لحقوق الزوجة المالية من خلال القواعد العامة في الإثبات المعتمدة في الفقه الإسلامي والقانون الجزائري، والآليات القانونية في حل نزاعات الملكية المشتركة بين الزوجين في حالة عدم وجود ما يثبتها، لنتوصل إلى أن الاتفاق على الأموال المكتسبة أثناء الحياة الزوجية أنها مملوكة ملكية مشتركة في كثير من الأسر الأمر الذي يستعدي وجوب توثيقها لضمان وحماية الحقوق المالية للزوجة. ""In this study, I dealt with the mechanisms of protecting the financial rights of the wife in Islamic Sharia and Algerian law, by studying the financial rights of the wife and mechanisms of legal protection and the financial system that can adopted as a legal mechanism to protect the financial right of the wife during the marital bond, and during the dissolution of the marital bond. This protection of wife’s financial right is through the general rules of evidence adopted in Islamic jurisprudence and Algerian law and legal mechanisms in resolving joint property disputes, between spouses in the absence of eviddance, to arrive at the agreement on the mony acquired during material life that it is owned jointly in many families, wich antagonizes, it is necessary to document it to ensure and protect the financial rights of the wife.
