العقود المستقبلية في سوق المال وأحكامها الفقهية

Abstract

"ملخص البحث: لقد شهدت الأسواق المالية العالمية في العقود الأخيرة تطورا سريعا، فكانت المشتقات المالية من الأدوات المالية المبتكرة، ومن أهمها العقود المستقبلية وذلك نظرا لحجم التعاملات بها في الأسواق المالية، لكن هل هذه العقود متوافقة مع مبادئ الشريعة الإسلامية؟ فهذا ما سنحاول معرفته من خلال هذا البحث المتواضع، لذا جاء في ثلاثة مباحث أحدها تمهيدي للموضوع عرّفت فيه الأسواق المالية وأهميتها ووظائفها وأنواعها وأدواتها المشتقة، وفي المبحث الأول نعرف فيه العقود المستقبلية وعناصرها ونشأتها والإجراءات المتخذة فيها قبل وأثناء وبعد إجراء هذه العقود وأغراض المتعاملين بها من تغطية (التحوط) ومضاربة، وفي المبحث الثاني عرجت على أحكام هذه العقود المستقبلية بأنواعها ورجحان حرمتها وبطلانها وما اقترحه بعض المتخصصين من بدائل شرعية لهذه العقود المبتكرة كالسَّلَم والاستصناع لتنشيط الأسواق المالية الإسلامية. " "Research Summary: In recent decades, global financial markets have known rapid progress. So, financial derivatives were from innovative financial instruments. The most important of which are futures contracts, because of the volume of transactions in the financial markets, but are these contracts in accordance with the principles of Islamic regulations? This is what we will try to know through this modest research. It came in three sections, the first one is introductory which I defined in it financial markets, their importance, their functions, their types and their derivative instruments. In the first section, we know the future contracts, their elements and their origin, and the procedures which are taken before, during and after the execution of these contracts and the purposes of their dealers of hedging and speculation. In the second section, I stated the provisions of these future contracts of all kinds and the preponderance of their sanctity and invalidity and what some specialists proposed of legitimate alternatives to these innovative contracts such as forward buying and tooling to stimulate Islamic financial markets.
