الأصول الاستدلالية للكليات الفقهية عند الإمام مالك من خلال المدونة

Abstract

لقد تميز المذهب المالكي في مجال الكليات الفقهية لحيازته قصب السبق في التأليف فيها واعتنائه بها غاية الاعتناء تدوينا وجمعا وتصنيفا، وكانت للإمام مالك يد طولى في هذا المقام وإسهامات جليلة تبرز من خلال تقليب النظر في منتجاته العلمية الرصينة وعلى رأسها كتاب المدونة، الذي تضمن أجوبة دقيقة اعتبرت بمثابة قوانين وكليات فقهية متينة شاملة للنازلة المسؤول عنها ولغيرها من نظرائها وشبيهاتها. وقد تغيى هذا المقال بيان الأدلة الشرعية التي بُنِيت عليها كليات الإمام مالك في مدونته التي جعلت محورا للدراسة التطبيقية لما لها من مكانة سامقة في المذهب المالكي والفقه الإسلامي : Abstract Malikism has distinguished itself in the entireties of jurisprudence from the other doctrines by its being the first to write in them and its being completely interested in them through recording, compiling and sorting. Imam Malik was a pioneer and had great participations displayed which come to light through viewing his thoughtful scientific writings, especially “Al Mudawwanah”, which contained accurate answers considered as solid laws and jurisprudence entirities responding to the matters in question as well as to similar questions. This article aims at showing the legal proofs on which were based the entireties of Imam Malik in his book “Al Mudawwanah” that was made the centre of practical studies seeing its high position in the Maliki doctrine and Islamic jurisprudence.
