Abstract
Constitutional oversight of laws has emerged as a mechanism for subordinating public
authorities to the Constitution, Started in the USA. The constitutions of Algeria, Tunisia and
Morocco were enshrined by constitutional councils; But the changes in the region have
prompted their countries to make constitutional amendments. The new Moroccan Constitution
was the first to emerge in 2011, followed by the Tunisian constitution in 2014, and finally the
Algerian amendments in 2016. These amendments gave, for the first time, individuals the right to
invoke unconstitutionality. Hence, the administrative judiciary in the two countries, within the
new constitutional parameters, will undoubtedly open up to the system of fundamental rights and
freedoms, which make it a worthy experience
