الوصية بالتبرع بالأعضاء

Abstract

اعتمدت عديد الدُّول مقاربات تُشجِّع مواطنيها على توثيق رغبتهم في التَّبرُّع بأعضائهم بعد الوفاة، وذلك باعتباره بديلاً آمنًا عن مخاطر وتعقيدات انتزاع العضو من إنسانٍ حيٍّ بُغية زرعه في بدنِ آخرَ. ولأهمِّية هذا الموضوع، والذي يعتبر من النَّوازل الفقهيَّة والقانونيَّة المعاصرة، كان بحثنا في هذا المضمار تحت عنوان: الوصيَّة بالتَّبرُّع بالأعضاء – دراسة مقارنة بين الشَّريعة الإسلاميَّة والقانون الجزائري، وقد عالجنا إشكاليَّته المتمثِّلة فيما يلي: إلى أيِّ مدَى وُفِّق المشرِّع الجزائري في ضبط أحكام الوصيَّة بالتَّبرُّع بالأعضاء وكذا تحقيق الانسجام مع قواعد الشَّريعة الإسلاميَّة في تنظيمها؟ هذه الإشكاليَّة حاولنا تناولها ضمن خطَّة تتضمَّن بدايةً الوصيَّة بالتَّبرُّع بالأعضاء في الشَّريعة الإسلاميِّة، تليها الوصيَّة بالتَّبرُّع بالأعضاء في القانون الجزائري، لنخلص بعد ذلك في الخاتمة لمجموعة من النَّتائج، أهمُّها أنَّ الوصيَّة بالتَّبرُّع بالأعضاء يمكنها أن تكون سببا في إنقاذ أرواحٍ كثيرة، وأنَّها تتوافق مع قواعد الشَّريعة ومقاصدها، وكذلك الإشارة إلى اعتماد المشرِّع الجزائري لأُطر قانونيَّة وتنظيميَّة لضبط العمليَّة وأخلقتها. Abstract: Many countries have adopted an approach to encourage their citizens to document their desire of organ donation after death. It is considered a safe alternative to the risks and the difficulties of organ removal from alive person in order to transplant it intro another body. This topic is considered one of the contemporary jurisprudential and legal issues due its importance. Hence, our research was entitled: the will of organ donation – a comparative study between the Islamic Law and the Algerian Law. We tackled its problematic aspects as follows : To what extant did the Algerian legislator succeed in regulating the rules of the will for organ donation and achieving the integrity with the rules of Islamic Shariah in its regulations? We tried to tackle this problematic issue through a plan that initially consists the will for organ donation in Islamic Shariah, followed by the will of organ donation in the Algerian Law. In the conclusion, we summarized the results. The most important one is that the will for organ donation can be a reason to save many lives and it agrees with the rules and the intention of Shariah. We also mentioned the adoption of the Algerian legislator of legal plans and regulations to regulate the process and its ethics.
