مفردات الـمالكيّة في باب العقيقة دراسة تأصيليّة تطبيقيّة

Abstract

"مما لا يخفى على كل طالب علم مشتغلٍ في حقل الدعوة ونشر العلم؛ أن باب العقيقة من الأبواب الفقهية التي يكثر السؤال عنها من طرف الناس، وبسبب انتشار وسائل التواصل الاجتماعي ووسائط البحث؛ أصبح الغالبية يأخذون أحكامها منها دون تـَحري الـحُكم من مصادره؛ فاختلط عليهم الأمر. وبما أن المذهب المالكي هو المعتمد في بلدنا؛ ارتأينا أن نجعل بحثنا موسوما بمفردات المذهب المالكي في باب العقيقة، لعله يضيف ولو بشكل بسيط إلى الفقه عموما والمالكي خصوصا، ويكشف ستار اللَّبس الواقع بين الباحثين والمتسائلين عن أحكام العقيقة التي انفرد بها هذا المذهب عن سواه من المذاهب الثلاث الأخرى، فعرضته في ثلاثة مباحث. خصّصت المبحث الأول للمفردات، وأسبابها مع بعض التآليف فيها، ثم عَرَّجت في المبحث الثاني على تعريف العقيقة، ومدى مشروعيتها، وبعض مسمياتها، والحكمة من تشريعها، أمَّا المبحث الثالث؛ فعدّدتُ فيه مفردات العقيقة مُبتَدئا بحكمها، ثم زمنها، فمقدارها، ثم مسألة كسر العظام، وجعلها وليمة، وتخصيص شيء منها للقابلة. والنتيجة الأساسية التي خلصت إليها هي كون تفرد المالكية بهذه المسائل عن الجمهور مردُّه إلى اختلاف أصولهم، والأدلة التي اعتمدوها للحكم على هذه المسائل عن غيرهم من علماء المذاهب، مع العلم أن معظم مسائل العقيقة يشارك فيها المالكية الجمهور. ""It is well known to every student of knowledge engaged in the field of da'wah and the dissemination of Islamic teachings that the chapter of ʿAqīqah is among the frequently asked-about fiqh topics. Due to the widespread use of social media and online search engines, most people now rely on these platforms for rulings, without verifying them from their original sources—leading to confusion and misinterpretation. Since the Mālikī madhhab is the officially adopted school of thought in our country, we decided to base our research on the specific views of the Mālikī school regarding ʿAqīqah. We hope this adds—at least in a modest way—to the body of Islamic jurisprudence in general and Mālikī fiqh in particular. This study aims to clarify the confusion that often surrounds the unique Mālikī rulings on ʿAqīqah, which differ from those of the other three madhāhib. The research is presented in three sections. The first section is dedicated to defining Mufradāt (unique positions) and explaining the reasons behind them, along with a brief overview of related writings. In the second section, I discussed the definition of ʿAqīqah, its legitimacy, other terms used for it, and the wisdom behind its legislation. The third section outlines the unique Mālikī views regarding ʿAqīqah, starting with its legal ruling, the appropriate time for performing it, the required amount, the issue of breaking the bones, whether it is considered a feast (walīmah), and the matter of giving a portion of it to the midwife (qābilah). The main conclusion I reached is that the Mālikī school's unique stance on these issues compared to the majority of scholars stems from the differences in their foundational principles and the evidences they relied upon. However, it is important to note that in most matters related to ʿAqīqah, the Mālikī school shares common ground with the other madhāhib. "
