Abstract

درس هذا البحثُ المبادئَ الدولية لحماية ضحايا النزاعات المسلَّحة في الشريعة الإسلامية والقانون الدولي، وقد جاء الموضوع مقسمًا إلى ثلاثة أجزاء، أمّا الأول فهو تمهيدي؛ وتم التطرق فيه إلى أهم مصطلحات الموضوع، وأمّا الثاني والثالث فقد خُصصا لذكر أهم المبادئ التي تحمي ضحايا الحروب؛ أحدهما في الشريعة الإسلامية، والآخر في القانون الدولي الإنساني، وقد ورد في كل منهما التعريف بالضحايا والنطاق العام لحمايتهم. This study is about international principles for the protection of victims of international conflicts in Islamic law (Shariaa) and international law, it was divided to three parts; the first is preliminary it was discussed the most important terms of the subject, the second and the third were privatized for most important principles to protect the victims of war, one of the parts is in Islamic law (Shariaa), the other in International humanitarian law, they were reported in each define the victims and the general scope of their protection.
