التكييف الفقهي للمعاملات المالية المعاصرة - دراسة تطبيقية على نماذج مختارة-

Abstract

"تعد اليوم النوازل والمستجدات الفقهية المعاصرة من أدق مسالك الفقه وأعوصها؛ مما يجعل الناظر في نوازله الفقهية يطرق أبوابًا لم تُطرق، وقد لا يفتح له منها باب إلا بجهد مضاعف ودراسة وافية وبحث مستفيض، عسى أن يظفر بحكمها وينال معرفتها ليخرج الناس من حيرة الإشكال فيها وظلمة الجهل بها. لهذا جاء بحثنا بعنوان: ""التكييف الفقهي للمعاملات المالية المعاصرة –نماذج مختارة-""؛ للإشارة إلى أصل له أهمية بالغة في ضبط هذا الفقه وبيان معالمه وتوضيح سبل الوصول إلى أحكامه، وقد تمت دراسة هذا الموضوع من خلال مبحثين، حيث خصص المبحث الأول للتعريف بالتكييف الفقهي وبيان أهمته ومختلف مجالاته، أما المبحث الثاني فقد اختُصَّ بذكر بعض النماذج المعاصرة للمعاملات المالية، التي يسهم التكييف الفقهي في وضع الخطوات الأولى للاجتهاد الصحيح في استنباط أحكامها، وختمت هذه الدراسة بخاتمة احتوت أهم النتائج المتوصل إليها مع تقديم أهم التوصيات."The Contemporary Juristic Nawazil and Novelties is one of the most accurate and challenging branches of Fiqh in which the examiner addresses and deals with a never addressed issue or incident before. That’s, a researcher relies on doubled efforts, adequate studying as well as a thorough researching an attempt to arrive at a ruling on a particular question; i.e., deriving its jurisprudential ruling and getting its deep understanding. Thanks to this, people get out of the depths and darkness of ignorance and from questioning as well. In this research, then, we contribute in such extent in determining precisely this type of jurisprudence; especially, the one which is related to the happened economic matters, its characteristics and how to get access to it focusing on the importance of the exact meaning of Nazila and illustrating its suitable flexibility in coping with Islamic legislation. Moreover, if the right juristic happened Nawazil is well studied and takes its enough accuracy, carefulness, the knowing how, comprehensiveness, and understanding, it will be the first step for the ijtihad in deriving the right rulings of Nawazil. Therefore, this research sheds light on the importance of this sort of understanding and also determining up and clarifying the obscure for the term “Juristic coping” which spreads and used widely by the Foquaha of Nawazil nowadays.
