حفظ مال المفقود في القانون الجزائري

Abstract

إن المفقود شخص غائب لا يعرف مكانه ولا تعرف حياته ولا موته، ولا يكتسب هذه الصفة قانونا إلا بحكم يقضي بذلك، فبعد الحكم باعتبار الشخص مفقودا يرتب هذا الحكم آثارا على زوجته وماله، وهذا الأخير وجب حفظه، لذا راعى المشرع الجزائري مسألة حفظ مال المفقود فألزم القاضي أن يعين في منطوق الحكم مقدما لتسيير مال المفقود لكنه غفل عن مسألة إن كان المفقود قد ترك وكيلا قبل فقده، أما من حيث الأحكام التي تنظم مسألة إدارة مال المفقود فألحقها بالأحكام التي تنظم حفظ مال القاصر رغم خصوصية كل منهما لأن الأول قد يحكم القاضي بموته أما الثاني فمآله البلوغ. إن المقدم مكلف قانونا بتسيير وإدارة مال المفقود، ويجب عليه بذل عناية الرجل الحريص لحفظ المال وإنمائه، وفي حالة تقصيره أو إهماله أو إتلافه لما وكل إليه يكون مسؤولا مدنيا وجزائيا. The missing person is an absent one whose place, life or death are unknown. This status is required only through a legal sentence after which some consequences are applied on his wife and properties. Thus, this property is preserved according to the Algerian legislator by the judge who appoints a representative to manage it neglecting the matter whether the missing person had already left an agent before his disappearance. Whereas, the provisions that organize the missing person’s properties are distributed under the minor’s properties management despite the specificities of each, since the former might be judged as a dead by the court while the latter will reach the puberty as an adult. The representative is legally charged with the management of the missing one’s property, but in case of default or destruction of the property, he is entrusted with civil and penal liability.
