اختيارات الفقهية للشيخ بكر أبو زيد في المعاملات المالية المعاصرة - جمعا ودراسة-

Abstract

"ملخص البحث تناولتُ في هذه الدراسة الموسومة بـــ ""الاختيارات الفقهية للشيخ بكر أبو زيد في المعاملات المالية المعاصرة"" اختيار الشخصية قيّد الدراسة لمسائل وقضايا تَلُوحُوا ضرورتها ومَسِيسُ الحاجة إليها بين الناس، وقد جاءت هذه الدراسة للإجابة على الإشكالية التالية: ما هي الاختيارات الفقهية لشيخ بكر أبو زيد في المعاملات المالية المعاصرة؟ وللإجابة على هذه الإشكالية الرئيسة قسَّمت الدراسة إلى ثلاثة مباحث، حيث شَكَّلَ المبحثين الأُولَيَّيْنِ الإطار النظري؛ فتطرق المبحث الأول إلى ترجمة بكر أبو زيد الذاتية والعلمية، لِيُتَعَرَّف على المكانة التي تبوأها الشخصية قيّد الدراسة، بينما عُقِدَ المبحث الثاني إطلالة وتوطئة وتهيئة وَعُنْوِنَ بالاختيارات الفقهية ومنهج بكر أبو زيد في تأسيسها، وأما المبحث الثالث وهو عنوان الدراسة؛ اختيارات بكر أبو زيد في باب المعاملات المالية المعاصرة، فهو المبحث التطبيقي حيث تناولت فيه بعض المعاملات المصرفية وكذلك أفرادا من البطاقات المصرفية وزيادة على ذلك قضايا معاصرة في البيوع. وقد توصلت إلى عدد من النتائج أهمها: بكر أبو زيد أحد قامات هذا العصر، وتعتبر كتبه من أجود ما خُطّ في زماننا، وقد وافق أصولَه ومنهجَه في غير ما اختيار، كما وافق الصواب ورافق جمهور العلماء في كثير من المسائل، وفتاويه موثوقة ومعتمدة يرجع إليها ويُعوّل عليها، كما أنه معظم للدليل يدور معه. ""Summary In this study, tagged with ""The Jurisprudential choices of Sheikh Bakr Abu Zayd in Contemporary Financial Transactions"", I dealt with the choice of personality under study for issues of great necessity and need among the people, and this study came to answer the following problem: What are the jurisprudential choices of Sheikh Bakr Abu Zaid in Contemporary financial transactions? In order to answer this main problem, the study was divided into three sections, where the first two sections formed the theoretical framework. The first topic dealt with Bakr Abu Zayd’s personal and scientific translation, to get acquainted with the position that the character under study occupied, while the second topic was held for an overview, preparation and entitled jurisprudential choices and Bakr Abu Zaid’s approach to its establishment. The third topic is the title of the study; Bakr Abu Zaid's choices in the chapter on contemporary financial transactions. It is the applied topic, in which I dealt with some banking transactions as well as individuals from bank cards, in addition to that, contemporary issues in sales. I have reached a number of results, the most important of which are: Bakr Abu Zayd has a high academic position, and his books are considered among the finest works of this era, and he agreed with his origins in weighting, as he clings to the evidence and revolves with him where the truth resides, and that he agreed with the truth and accompanied the majority of the scientists in more than one issue of the issues, and that his fatwas are due to it and rely on it.
